Commission Implementing Regulation (EU) 2021/405 of 24 March 2021 laying down the lists of third countries or regions thereof authorised for the entry into the Union of certain animals and goods intended for human consumption in accordance with Regulation (EU) 2017/625 of the European Parliament and of the Council (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations (EC) No 999/2001, (EC) No 396/2005, (EC) No 1069/2009, (EC) No 1107/2009, (EU) No 1151/2012, (EU) No 652/2014, (EU) 2016/429 and (EU) 2016/2031 of the European Parliament and of the Council, Council Regulations (EC) No 1/2005 and (EC) No 1099/2009 and Council Directives 98/58/EC, 1999/74/EC, 2007/43/EC, 2008/119/EC and 2008/120/EC, and repealing Regulations (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council, Council Directives 89/608/EEC, 89/662/EEC, 90/425/EEC, 91/496/EEC, 96/23/EC, 96/93/EC and 97/78/EC and Council Decision 92/438/EEC (Official Controls Regulation) OJ L 95, 7.4.2017, p. 1. , and in particular Article 127(2) thereof, Whereas: (1) Regulation (EU) 2017/625 lays down rules for official controls and other control activities performed by the competent authorities of the Member States in order to verify compliance with Union legislation in the area of, among others, food safety at all stages of the production, processing and distribution process. In particular, it provides that consignments of certain animals and goods are only to enter the Union from a third country or region thereof which appears on a list drawn up by the Commission for that purpose. (2) Commission Delegated Regulation (EU) 2019/625 Commission Delegated Regulation (EU) 2019/625 of 4 March 2019 supplementing Regulation (EU) 2017/625 of the European Parliament and of the Council with regard to requirements for the entry into the Union of consignments of certain animals and goods intended for human consumption (OJ L 131, 17.5.2019, p. 18). supplements Regulation (EU) 2017/625 as regards the conditions for the entry into the Union of consignments of certain animals and goods intended for human consumption from third countries or regions thereof in order to ensure that they comply with the relevant requirements established in the rules referred to in Article 1(2)(a) of Regulation (EU) 2017/625 (food safety) or with requirements recognised to be at least equivalent. In particular, it identifies the animals and goods intended for human consumption that are subject to the requirement to come from a third country or region thereof listed in accordance with Article 126(2)(a) of Regulation (EU) 2017/625. (3) Commission Implementing Regulation (EU) 2019/626
Commission Implementing Regulation (EU) 2019/626 of 5 March 2019 concerning lists of third countries or regions thereof authorised for the entry into the European Union of certain animals and goods intended for human consumption, amending Implementing Regulation (EU) 2016/759 as regards these lists (OJ L 131, 17.5.2019, p. 31). lays down the lists of third countries or regions thereof authorised for the entry into the Union of the animals and the goods identified in Article 3 of Delegated Regulation (EU) 2019/625. (4) In accordance with Article 127 of Regulation (EU) 2017/625, these lists include only third countries or regions thereof, which have submitted appropriate evidence and guarantees that the animals and goods concerned comply with the requirements of Union legislation in the area of food safety. (5) Regulation (EC) No 853/2004 of the European Parliament and of the Council Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin (OJ L 139, 30.4.2004, p. 55). provides that food business operators importing products of animal origin from third countries or regions thereof are to ensure that the third country of dispatch appears on a list of third countries from which imports of such products are permitted. (6) In addition to complying with Union legislation in the area of food and food safety, animals and goods from third countries entering the Union are to comply with Union legislation in the area of animal health. To this end, Regulation (EU) 2016/429 of the European Parliament and of the Council Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (Animal Health Law) (OJ L 84, 31.3.2016, p. 1). provides that Member States are to permit the entry into the Union of certain consignments of animals, germinal products and products of animal origin from third countries or territories only if those goods come from a third country or territory listed for that purpose. (7) Commission Implementing Regulation (EU) 2021/404 Commission Implementing Regulation (EU) 2021/404 of 24 March 2021 laying down the lists of third countries, territories or parts thereof from which the entry into the Union of animals, germinal products and products of animal origin is permitted in accordance with Regulation (EU) 2016/429 of the European Parliament and of the Council (See page 1 of this Official Journal). lays down the lists of third countries or regions thereof authorised for the entry into the Union of certain animals and goods with regard to animal health requirements, in accordance with the criteria laid down in Article 230(1) of Regulation (EU) 2016/429 and with the relevant animal health requirements laid down in Commission Delegated Regulation (EU) 2020/692 Commission Delegated Regulation (EU) 2020/692 of 30 January 2020 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council as regards rules for entry into the Union, and the movement and handling after entry of consignments of certain animals, germinal products and products of animal origin (OJ L 174, 3.6.2020, p. 379).
. (8) Delegated Regulation (EU) 2020/692 repeals, with effect from 21 April 2021, a number of Commission acts laying down lists of third countries or regions thereof authorised for the entry into the Union of consignments of certain animals, germinal products and products of animal origin. Of these lists, those established with regard to food safety requirements should be laid down in the present Regulation, with effect from 21 April 2021. (9) The third countries or regions thereof from which entry into the Union of consignments of certain animals and goods is permitted have already provided appropriate evidence and guarantees to ensure that the animals and goods authorised for the entry into the Union comply with requirements laid down in Article 4(a) to (e) of Delegated Regulation (EU) 2019/625. Therefore, a re-assessment of compliance with these requirements is not necessary. (10) Article 4(f) of Delegated Regulation (EU) 2019/625 provides that the existence, implementation and communication of a residues control programme approved by the Commission, when applicable, is a prerequisite for the inclusion of third countries or regions thereof in the list referred to in Article 126(2)(a) of Regulation (EU) 2017/625. Commission Decision 2011/163/EU Commission Decision 2011/163/EU of 16 March 2011 on the approval of plans submitted by third countries in accordance with Article 29 of Council Directive 96/23/EC (OJ L 70, 17.3.2011, p. 40). lays down the list of third countries whose residues control programme have been approved by the Commission. (11) Certain countries are currently listed in Implementing Regulation (EU) 2019/626 for animals and goods, for which they are not listed in Decision 2011/163/EU, and are consequently not authorized for entry of these animals or goods into the Union. Since these countries do not fulfil the requirements of Article 4(f) of Delegated Regulation (EU) 2019/625, the countries should not be listed in the present Regulation. (12) Considering the numerous amendments necessary, Implementing Regulation (EU) 2019/626 should be repealed and replaced by the present Regulation. (13) As Delegated Regulation (EU) 2020/692 and Implementing Regulation (EU) 2021/404 apply from 21 April 2021, this Regulation should also apply from that date. (14) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, HAS ADOPTED THIS REGULATION:
Article 1
Subject matter and scope This Regulation lays down the lists of third countries or regions thereof from which the entry into the Union of consignments of certain animals and goods intended for human consumption is permitted in accordance with Article 126(2)(a) of Regulation (EU) 2017/625.
Article 2
Definitions For the purpose of this Regulation, the following definitions shall apply: (1) fresh meat means fresh meat as defined in point 1.10 of Annex I to Regulation (EC) No 853/2004; (2) meat preparations means meat preparations as defined in point 1.15 of Annex I to Regulation (EC) No 853/2004;
(3) domestic solipeds means animals of the species Equus caballus, Equus asinus and their cross-breeds; (4) wild solipeds means animals of the subgenus Hippotigris; (5) offal means offal as defined in point 1.11 of Annex I to Regulation (EC) No 853/2004; (6) meat means meat as defined in point 1.1 of Annex I to Regulation (EC) No 853/2004; (7) minced meat means minced meat as defined in point 1.13 of Annex I to Regulation (EC) No 853/2004; (8) poultry means poultry as defined in point 1.3 of Annex I to Regulation (EC) No 853/2004; (9) wild leporidae means rabbits and hares that are not kept by humans; (10) wild game means wild game as defined in point 1.5 of Annex I to Regulation (EC) No 853/2004; (11) farmed game means farmed game as defined in point 1.6. of Annex I to Regulation (EC) No 853/2004; (12) eggs means eggs as defined in point 5.1 of Annex I to Regulation (EC) No 853/2004; (13) egg products means egg products as defined in point 7.3 of Annex I to Regulation (EC) No 853/2004; (14) meat products means meat products as defined in point 7.1 of Annex I to Regulation (EC) No 853/2004; (15) treated stomachs, bladders and intestines means treated stomachs, bladders and intestines as defined in point 7.9 of Annex I to Regulation (EC) No 853/2004; (16) casings means casings as defined in point (45) of the second paragraph of Article 2 of Delegated Regulation (EU) 2020/692; (17) rendered animal fat means rendered animal fat as defined in point 7.5 of Annex I to Regulation (EC) No 853/2004; (18) greaves means greaves as defined in point 7.6 of Annex I to Regulation (EC) No 853/2004; (19) bivalve molluscs means bivalve molluscs as defined in point 2.1 of Annex I to Regulation (EC) No 853/2004; (20) fishery products means fishery products as defined in point 3.1 of Annex I to Regulation (EC) No 853/2004; (21) raw milk means raw milk as defined in point 4.1 of Annex I to Regulation (EC) No 853/2004; (22) dairy products means dairy products as defined in point 7.2. of Annex I to Regulation (EC) No 853/2004; (23) colostrum means colostrum as defined in point 1 of Section IX of Annex III to Regulation (EC) No 853/2004; (24) colostrum-based products means colostrum-based products as defined in point 2 of Section IX of Annex III to Regulation (EC) No 853/2004; (25) frogs legs’ means frogs’ legs as defined in point 6.1 of Annex I to Regulation (EC) No 853/2004 and any other frogs’ legs of the genera Pelophylax from the family of Ranidae, and of the genera Limnonectes, Fejervarya and Hoplobatrachus from the family of Dicroglossidae; (26) snails means snails as defined in point 6.2 of Annex I to Regulation (EC) No 853/2004 and any other snails of the family of Helicidae, Hygromiidae or Sphincterochilidae; (27) gelatine means gelatine as defined in point 7.7 of Annex I to Regulation (EC) No 853/2004; (28) collagen means collagen as defined in point 7.8 of Annex I to Regulation (EC) No 853/2004; (29) honey means honey as defined in point 1 of Part IX of Annex II of Regulation (EU) No 1308/2013 of the European Parliament and of the Council
Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (OJ L 347, 20.12.2013, p. 671). ; (30) apiculture products means apiculture products as defined in point 2 of Part IX of Annex II to Regulation (EU) No 1308/2013; (31) reptile meat means reptile meat as defined in point (16) of Article 2 of Delegated Regulation (EU) 2019/625; (32) insects means insects as defined in point (17) of Article 2 of Delegated Regulation (EU) 2019/625; (33) day-old chicks means day-old chicks as defined in point (19) of Article 2 of Delegated Regulation (EU) 2020/692; (34) hatching eggs means hatching eggs as defined in point (44) of Article 4 of Regulation (EU) 2016/429; (35) breeding poultry means breeding poultry as defined in point (17) of Article 2 of Delegated Regulation (EU) 2020/692; (36) productive poultry means productive poultry as defined in point (18) of Article 2 of Delegated Regulation (EU) 2020/692; (37) animals intended for slaughter means animals intended for slaughter as defined in point (13) of Article 2 of Delegated Regulation (EU) 2020/692.
Article 3
List of third countries or regions thereof authorised for the entry into the Union of consignments of fresh meat and meat preparations of ungulates other than solipeds Consignments of fresh meat and meat preparations of ungulates other than solipeds, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XIII to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU.
Article 4
List of third countries authorised for the entry into the Union of consignments of fresh meat, excluding minced meat, and of meat preparations of domestic solipeds Consignments of fresh meat, excluding minced meat, and of meat preparations of domestic solipeds, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex I.
Article 5
List of third countries authorised for the entry into the Union of consignments of fresh meat, excluding offal and minced meat, and of meat preparations of wild solipeds Consignments of fresh meat, excluding offal and minced meat, and of meat preparations of wild solipeds, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex II.
Article 6
List of third countries or regions thereof authorised for the entry into the Union of consignments of fresh meat of poultry, ratites and wild game birds, and meat preparations of poultry Consignments of fresh meat of poultry, ratites and wild game birds, and meat preparations of poultry, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XIV to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU.
Consignments of fresh meat of wild game birds intended for human consumption that are unplucked and uneviscerated and come from third countries listed in Annex III shall only be authorised for the entry into the Union if they are transported by aeroplane.
Article 7
List of third countries or regions thereof authorised for the entry into the Union of consignments of eggs and egg products Consignments of eggs and egg products, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XIX to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU for eggs. Consignments of eggs intended for placing on the market as Class A eggs in accordance with Article 2 of Commission Regulation (EC) No 589/2008 Commission Regulation (EC) No 589/2008 of 23 June 2008 laying down detailed rules for implementing Council Regulation (EC) No 1234/2007 as regards marketing standards for eggs (OJ L 163, 24.6.2008, p. 6). shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex IV in order to comply with the requirements on Salmonella control in accordance with Article 10(6) of Regulation (EC) No 2160/2003 of the European Parliament and of the Council Regulation (EC) No 2160/2003 of the European Parliament and of the Council of 17 November 2003 on the control of salmonella and other specified food-borne zoonotic agents (OJ L 325, 12.12.2003, p. 1). .
Article 8
List of third countries authorised for the entry into the Union of consignments of fresh meat of farmed rabbit, and of fresh meat of wild leporidae not containing offal except for unskinned and uneviscerated wild leporidae Consignments of fresh meat of farmed rabbit and of fresh meat of wild leporidae not containing offal except for unskinned and uneviscerated wild leporidae, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex V.
Article 9
List of third countries authorised for the entry into the Union of consignments of fresh meat of wild land mammals other than ungulates and leporidae, not containing offal Consignments of fresh meat of wild land mammals other than ungulates and leporidae, not containing offal and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex VI.
Article 10
List of third countries or regions thereof authorised for the entry into the Union of consignments of meat products, including rendered animals fats, greaves, meat extracts and treated stomachs, bladders and intestines, and excluding casings Consignments of meat products, including rendered animals fats, greaves, meat extracts and treated stomachs, bladders and intestines, and excluding casings, of leporidae, of solipeds, and of wild land mammals other than ungulates and leporidae, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex VII.
Consignments of meat products, including rendered animals fats, greaves, meat extracts and treated stomachs, bladders and intestines, and excluding casings, of other species than those referred to in the first paragraph, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XV to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU.
Article 11
List of third countries or regions thereof authorised for the entry into the Union of consignments of casings Consignments of casings intended for human consumption shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XVI to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU for casings.
Article 12
List of third countries or regions thereof authorised for the entry into the Union of consignments of live, chilled, frozen or processed bivalve molluscs, echinoderms, tunicates and marine gastropods Consignments of live, chilled, frozen or processed bivalve molluscs, echinoderms, tunicates and marine gastropods, and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex VIII. Nevertheless, entry into the Union of adductor muscles of pectinidae other than aquaculture animals, completely separated from the viscera and gonads and intended for human consumption, shall also be permitted from third countries not appearing on that list.
Article 13
List of third countries or regions thereof authorised for the entry into the Union of consignments of certain fishery products Consignments of fishery products intended for human consumption shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex IX. This does not apply to consignments of animals and goods covered by Article 12.
Article 14
List of third countries authorised for the entry into the Union of consignments of raw milk, colostrum, colostrum-based products and dairy products of solipeds Consignments of raw milk, colostrum, colostrum-based products and dairy products of solipeds, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex X.
Article 15
List of third countries or regions thereof authorised for the entry into the Union of consignments of raw milk, colostrum, colostrum-based products and dairy products, not required to undergo a specific risk-mitigating treatment against foot-and-mouth disease Consignments of raw milk, colostrum, colostrum-based products and dairy products, not required to undergo a specific risk-mitigating treatment against foot-and-mouth disease and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XVII to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU for milk.
Article 16
List of third countries or regions thereof authorised for the entry into the Union of consignments of dairy products required to undergo a specific risk-mitigating treatment against foot-and-mouth disease Consignments of dairy products required to undergo a specific risk-mitigating treatment against foot-and-mouth disease and intended for human consumption shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry into the Union in accordance with Annex XVIII to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU for milk.
Article 17
List of third countries or regions thereof authorised for the entry into the Union of consignments of frogs’ legs and of snails Consignments of frogs’ legs and of snails, intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex XI.
Article 18
List of third countries or regions thereof authorised for the entry into the Union of consignments of gelatine and collagen
- Consignments of gelatine and collagen, derived from bovine, ovine, caprine, porcine and soliped animals and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex XII.
- Consignments of gelatine and collagen, derived from poultry and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex XIII.
- Consignments of gelatine and collagen, derived from fishery products and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex IX.
- Consignments of gelatine and collagen, derived from leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex V.
- Consignments of gelatine and collagen, derived from wild land mammals other than ungulates and leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex VI.
Article 19
List of third countries or regions thereof authorised for the entry into the Union of consignments of raw materials for the production of gelatine and collagen
- Consignments of raw materials for the production of gelatine and collagen, derived from bovine, ovine, caprine and porcine animals and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry of consignments of fresh meat of the specific ungulates into the Union in accordance with Annex XIII to Implementing Regulation (EU) 2021/404.
- Consignments of raw materials for the production of gelatine and collagen, derived from solipeds and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex I for domestic solipeds or in Annex II for wild solipeds.
- Consignments of raw materials for the production of gelatine and collagen, derived from poultry and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry of consignments of fresh meat of the respective species into the Union in accordance with Annex XIV to Implementing Regulation (EU) 2021/404.
- Consignments of raw materials for the production of gelatine and collagen, derived from fishery products and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex IX.
- Consignments of raw materials for the production of gelatine and collagen, derived from leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex V.
- Consignments of raw materials for the production of gelatine and collagen, derived from wild land mammals other than ungulates and leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex VI.
Article 20
List of third countries or regions thereof authorised for the entry into the Union of consignments of treated raw materials for the production of gelatine and collagen
- Consignments of treated raw materials for the production of gelatine and collagen, derived from bovine, ovine, caprine, porcine and soliped animals and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex XII.
- Consignments of treated raw materials for the production of gelatine and collagen, derived from poultry and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex XIII.
- Consignments of treated raw materials for the production of gelatine and collagen, derived from fishery products and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof that are listed in Annex IX.
- Consignments of treated raw materials for the production of gelatine and collagen, derived from leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex V.
- Consignments of treated raw materials for the production of gelatine and collagen, derived from wild land mammals other than ungulates and leporidae and intended for human consumption, shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex VI.
- Consignments of treated raw materials for the production of gelatine and collagen, referred to in point 4(b)(iii) of Chapter I of Section XIV of Annex III to Regulation (EC) No 853/2004, shall only be authorised for the entry into the Union if they come from the third countries or regions thereof authorised for the entry of consignments of treated raw materials derived from those commodities into the Union in accordance with Article 19 of this Regulation.
Article 21
List of third countries authorised for the entry into the Union of consignments of honey and other apiculture products Consignments of honey and other apiculture products intended for human consumption shall only be authorised for the entry into the Union if they come from the third countries listed in Decision 2011/163/EU for honey.
Article 22
List of third countries or regions thereof authorised for the entry into the Union of consignments of certain highly refined products Consignments of highly refined chondroitin sulphate, hyaluronic acid, other hydrolysed cartilage products, chitosan, glucosamine, rennet, isinglass and amino acids, intended for human consumption, shall only be authorised for the entry into the Union if they come from the following third countries or regions thereof: (a) in the case of highly refined products derived from ungulates, the third countries or regions thereof that are listed in Annex XII; (b) in the case of highly refined products derived from fishery products, the third countries or regions thereof that are listed in Annex IX; (c) in the case of highly refined products derived from poultry, the third countries that are listed in Annex XIII.
Article 23
List of third countries authorised for the entry into the Union of consignments of reptile meat Consignments of reptile meat intended for human consumption shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex XIV.
Article 24
List of third countries authorised for the entry into the Union of consignments of insects Consignments of insects intended for human consumption shall only be authorised for the entry into the Union if such foods are originated in and consigned from the third countries that are listed in Annex XV.
Article 25
List of third countries or regions thereof authorised for the entry into the Union of consignments of other products of animal origin Consignments of products of animal origin other than those referred to in Articles 3 to 24, and intended for human consumption, shall only be authorised for the entry into the Union if they come from the following third countries or regions thereof: (a) if derived from domestic ungulates other than domestic solipeds, the third countries or regions thereof authorised for the entry of fresh meat of domestic ungulates into the Union in accordance with Annex XIII to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU when applicable; (b) if derived from domestic solipeds, the third countries that are listed in Annex I; (c) if derived from poultry, the third countries or regions thereof authorised for the entry of fresh poultry meat into the Union in accordance with Annex XIV to Implementing Regulation (EU) 2021/404 and listed in Decision 2011/163/EU when applicable; (d) if derived from fishery products, the third countries or regions thereof that are listed in Annex IX; (e) if derived from leporidae, the third countries that are listed in Annex V;
(f) if derived from wild land mammals other than ungulates and leporidae, the third countries that are listed in Annex VI; (g) if derived from more than one species, the third countries or regions thereof that are listed for each species from which the products are derived, in accordance with points (a) to (e).
Article 26
List of third countries authorised for the entry into the Union of consignments of live poultry and of hatching eggs of the species Gallus gallus, of live turkeys and of hatching eggs of turkeys Without prejudice to the lists drawn up with regard to animal health requirements in Annex V to Implementing Regulation (EU) 2021/404, consignments of live poultry and of hatching eggs of the species Gallus gallus, of live turkeys and of hatching eggs of turkeys shall only be authorised for the entry into the Union if they come from the third countries that are listed in Annex XVI. The listing requirements laid down in the first paragraph of this Article shall not apply to single consignments of less than 20 units of live poultry other than ratites, hatching eggs and day-old chicks thereof, when destined for primary production of live poultry for private domestic use or when leading to the direct supply, by the producer, of small quantities of primary products, as referred to in Article 1(3) of Regulation (EC) No 2160/2003.
Article 27
Repeal Implementing Regulation (EU) 2019/626 is repealed. References to the repealed Implementing Regulation shall be construed as references to this Regulation and read in accordance with the correlation table in Annex XVII.
Article 28
Entry into force and application This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. It shall apply from 21 April 2021. This Regulation shall be binding in its entirety and directly applicable in all Member States. Done at Brussels, 24 March 2021.
