Commission Implementing Decision (EU) 2023/837 of 17 April 2023 amending Implementing Decision (EU) 2021/1803 setting out the provisional amounts allocated to each Member State from the resources of the Brexit Adjustment Reserve and the minimum amount of support to local and regional coastal communities (notified under document C(2023) 2459) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2021/1755 of the European Parliament and of the Council of 6 October 2021 establishing the Brexit Adjustment Reserve OJ L 357, 8.10.2021, p. 1. , and in particular Article 4(5) thereof, Whereas: (1) On 8 October 2021, the Commission adopted Implementing Decision (EU) 2021/1803 Commission Implementing Decision (EU) 2021/1803 of 8 October 2021 setting out the provisional amounts allocated to each Member State from the resources of the Brexit Adjustment Reserve and the minimum amount of support to local and regional coastal communities (OJ L 362, 12.10.2021, p. 3). setting out the provisional amounts allocated to each Member State from the resources of the Brexit Adjustment Reserve in accordance with the methodology laid down in Annex I to Regulation (EU) 2021/1755, as well as the minimum amount of resources to be spent in accordance with Article 4(4) of that Regulation. (2) Pursuant to Article 4a(1) of Regulation (EU) 2021/1755 Member States may submit to the Commission a reasoned request to transfer to the Recovery and Resilience Facility, established by Regulation (EU) 2021/241 of the European Parliament and of the Council Regulation (EU) 2021/241 of the European Parliament and of the Council of 12 February 2021 establishing the Recovery and Resilience Facility (OJ L 57, 18.2.2021, p. 17). , all or part of the amounts of their provisional allocation set out in the implementing act referred to in Article 4(5) of Regulation (EU) 2021/1755. (3) In accordance with Article 4a(3) of Regulation (EU) 2021/1755 where a Member State chooses to transfer all or part of its provisional allocation to the Recovery and Resilience Facility in accordance with Article 4a, the amounts to be spent for the purposes of Article 4(4), first subparagraph, are to be proportionately reduced. (4) Twenty three Member States have submitted a reasoned request to transfer a total amount of EUR 2089446003 from the Brexit Adjustment Reserve to the Recovery and Resilience Facility. The Commission has assessed those requests positively. (5) Implementing Decision (EU) 2021/1803 should therefore be amended accordingly. (6) For reasons of programming, global provisional amounts allocated to each Member State should be given in current prices, HAS ADOPTED THIS DECISION:

In Implementing Decision (EU) 2021/1803, the Annex is replaced by the text set out in the Annex to this Decision.
