Commission Implementing Decision (EU) 2024/2053 of 30 July 2024 allocating rights to produce hydrofluorocarbons pursuant to Article 14 of Regulation (EU) 2024/573 of the European Parliament and of the Council on fluorinated greenhouse gases to producers that produced such substances in 2022 (notified under document C(2024) 5212) (Only the French and German texts are authentic) (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2024/573 of the European Parliament and of the Council of 7 February 2024 on fluorinated greenhouse gases, amending Directive (EU) 2019/1937 and repealing Regulation (EU) No 517/2014 OJ L, 2024/573, 20.2.2024, ELI: http://data.europa.eu/eli/reg/2024/573/oj. , and in particular Article 14(3) thereof, Whereas: (1) Article 14(2) of Regulation (EU) 2024/573 limits the production of hydrofluorocarbons according to the phase-down schedule set out in Annex V of that Regulation, enabling Member States to comply with their individual obligation to reduce production of hydrofluorocarbons in accordance with Article 2J(3) of the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer Council Decision 88/540/EEC of 14 October 1988 concerning the conclusion of the Vienna Convention for the protection of the ozone layer and the Montreal Protocol on substances that deplete the ozone layer (OJ L 297, 31.10.1988, p. 8, ELI: http://data.europa.eu/eli/dec/1988/540/oj). (the Montreal Protocol). (2) The production rights for each producer are to be calculated on the basis of Article 14(1) and Annex V of Regulation (EU) 2024/573, which reflect the obligations of the Member States under the Montreal Protocol, ensuring that producers of hydrofluorocarbons with production on their territory reduce their production accordingly. (3) Pursuant to Article 14(6) Regulation (EU) 2024/573 the production rights are subject to a review every 3 years after adoption of this Decision and may be amended at the request of the competent authority of a Member State or following a revision of Annex V in the context of the revision of the Regulation pursuant to its Article 35 or when necessary to comply with obligations under the Montreal Protocol. (4) The measures provided for in this Decision are in accordance with the opinion of the Committee on fluorinated greenhouse gases, HAS ADOPTED THIS DECISION:

Article 1

Production rights The production rights for hydrofluorocarbons allocated to each producer for the periods 1 January 2025 to 31 December 2028, 1 January 2029 to 31 December 2033, 1 January 2034 to 31 December 2035 and 1 January 2036 and thereafter are set out in the Annex.
