Council Decision (CFSP) 2024/2876 of 8 November 2024 amending Decision (CFSP) 2022/1968 on a European Union Military Assistance Mission in support of Ukraine (EUMAM Ukraine) THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union, and in particular Article 42(4) and Article 43(2) thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy, Whereas: (1) The European Council, in its conclusions of 24 February 2022, as well as in subsequent conclusions, condemned in the strongest possible terms Russia’s unprovoked and unjustified military aggression against Ukraine and reiterated its unwavering support for the independence, sovereignty and territorial integrity of Ukraine within its internationally recognised borders. (2) On 17 October 2022, the Council adopted Decision (CFSP) 2022/1968 Council Decision (CFSP) 2022/1968 of 17 October 2022 on a European Union Military Assistance Mission in support of Ukraine (EUMAM Ukraine) (OJ L 270, 18.10.2022, p. 85). , establishing a European Military Assistance Mission in support of Ukraine (EUMAM Ukraine) with the strategic objective of contributing to enhancing the military capacity of Ukraine’s Armed Forces to regenerate and to effectively conduct operations, in order to allow Ukraine to defend its territorial integrity within its internationally recognised borders, effectively exercise its sovereignty and protect the civilians in Ukraine. (3) On 14 November 2022, the Council adopted Decision (CFSP) 2022/2243 Council Decision (CFSP) 2022/2243 of 14 November 2022 launching the European Union Military Assistance Mission in support of Ukraine (EUMAM Ukraine) (OJ L 294, 15.11.2022, p. 21). , which launched EUMAM Ukraine. (4) On 21 March 2024, the European Council welcomed the increased capacity of EUMAM Ukraine. (5) The European Council, in its conclusions of 27 June 2024, recalled its previous conclusions on continued support for Ukraine’s independence, sovereignty and territorial integrity within its internationally recognised borders and reconfirmed the European Union’s unwavering commitment to providing continued political, financial, economic, humanitarian, military and diplomatic support to Ukraine and its people for as long as it takes and as intensely as needed. Furthermore, the European Council stated that in order to better help meet the training needs of the Ukrainian military, the Union stands ready to further increase the capacity of EUMAM Ukraine. (6) On 3 September 2024, the Political and Security Committee (PSC) agreed, in the context of the strategic review of EUMAM Ukraine, that EUMAM Ukraine should be extended until 15 November 2026. Moreover, the PSC agreed that the necessary exchange of classified information should be authorised between EUMAM Ukraine and NATO Security Assistance and Training for Ukraine in an inclusive, reciprocal and non-discriminatory way. (7) On 22 October 2024, the PSC agreed that a strategic assessment of EUMAM Ukraine should be presented no later than January 2025 with a view to a decision to enhance EUMAM Ukraine’s capabilities and effectiveness.

(8) Decision (CFSP) 2022/1968 should therefore be amended accordingly, HAS ADOPTED THIS DECISION:

Article 1

Decision (CFSP) 2022/1968 is amended as follows: (1) in Article 7, the following paragraph is added: 4. EUMAM Ukraine shall cooperate with NATO, in particular NATO Security Assistance and Training for Ukraine (NSATU), in full respect of the principles of transparency, reciprocity and inclusiveness, as well as the decision-making autonomy and procedures of both organisations. ; (2) in Article 11, the following paragraph is added: 6. The financial reference amount for the common costs of EUMAM Ukraine for the period from 14 November 2024 to 15 November 2026 shall be EUR 408800000. The percentage of the reference amount referred to in Article 51(2) of Decision (CFSP) 2021/509 shall be 0 % for commitments and 0 % for payments. ; (3) in Article 13, paragraph 2 is replaced by the following: 2. The HR shall also be authorised to release to Ukraine, the USA, the UK, Canada, NSATU and the IDCC, in accordance with the operational needs of EUMAM Ukraine, EU classified information up to RESTREINT UE/EU RESTRICTED level which are generated for the purposes of EUMAM Ukraine, in accordance with Decision 2013/488/EU. The necessary arrangements between the HR and the competent authorities of Ukraine, NSATU and the IDCC shall be drawn up for that purpose. ; (4) in Article 14, paragraphs 1 and 2 are replaced by the following:

1. This Decision shall enter into force on the date of its adoption. It shall apply until 15 November 2026.
2. A strategic assessment of EUMAM Ukraine shall be presented no later than January 2025. A strategic review of EUMAM Ukraine shall be conducted in good time before the expiry of this Decision..
