Council Decision (CFSP) 2024/… of 16 December 2024 amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union and in particular Article 29 thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy, Whereas: (1) On 31 July 2014, the Council adopted Decision 2014/512/CFSP Council Decision 2014/512/CFSP of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014, p. 13, ELI: http://data.europa.eu/eli/dec/2014/512/oj). . (2) The Union remains unwavering in its support for Ukraine’s sovereignty and territorial integrity. (3) In its conclusions of 17 October 2024, the European Council reiterated its resolute condemnation of Russia’s war of aggression against Ukraine, which constitutes a manifest violation of the Charter of the United Nations, and reaffirmed its continued support for Ukraine’s independence, sovereignty and territorial integrity within its internationally recognised borders. The European Council also expressed the readiness of the Union to further limit Russia’s ability to wage war, including by further sanctions and measures to counter their circumvention, including through third countries. (4) In view of the gravity of the situation, it is appropriate to adopt further restrictive measures. (5) It is appropriate to add 32 entities to the list of natural or legal persons, entities and bodies set out in Annex IV to Decision 2014/512/CFSP, namely the list of persons, entities and bodies supporting Russia’s military-industrial complex in its war of aggression against Ukraine, on which tighter export restrictions regarding dual-use goods and technology, as well as goods and technology which might contribute to the technological enhancement of Russia’s defence and security sector, are imposed. That list includes certain entities in third countries other than Russia that indirectly contribute to Russia’s military and technological enhancement through the circumvention of export restrictions, including on Unmanned Aerial Vehicles or missiles. (6) In order to further constrain the activity of vessels operated to contribute or support actions or policies supporting Russia’s actions against Ukraine, it is also appropriate to add further vessels to the list of vessels set out in Annex XVI to Decision 2014/512/CFSP, on which a ban from Member States’ ports and locks, as well as a ban on the provision of a broad range of services related to maritime transport, are imposed. (7) As stated in recital 16 of Council Decision (CFSP) 2024/1470 Council Decision (CFSP) 2024/1470 of 21 May 2024 amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ L, 2024/1470, 22.5.2024, ELI: http://data.europa.eu/eli/dec/2024/1470/oj).

, cash balances of or with customers of central securities depositories are usually transferred out of those central securities depositories before the end of the day and do not yield any remuneration for customers. Therefore, central securities depositories, as referred to in Article 1a(8) of Decision 2014/512/CFSP, are not liable to pay interest or any other form of compensation to the person, entity or body entitled to the assets and reserves referred to in Article 1a(4) of that Decision, and which those central securities depositories hold or control or are a counterparty to, other than as contractually agreed. (8) The management by a relevant central securities depository of assets subject to the transaction ban imposed pursuant to Article 1a(4) of Decision 2014/512/CFSP, as well as the management of the cash balances stemming from such assets, should not give rise to liability of any kind on the part of that depository, or of its directors or employees, unless it is proved that the action was a result of negligence. (9) Recently, Russian courts have issued decisions based on Article 248 of the Arbitration Procedure Code of the Russian Federation that prohibit the initiation or continuation of proceedings in foreign courts or tribunals on the part of European companies against Russian companies (anti-suit injunctions), and have issued, inter alia, disproportionately high financial penalties in cases of failure to comply. The Union considers that the manner in which Russian courts issue such anti-suit injunctions and fines is in clear violation of established international principles and long-standing practices in the resolution of international business disputes. In order to prevent efforts by claimants to enforce such anti-suit injunctions or fines, or any other court decision based on Article 248 or equivalent Russian legislation, it is appropriate to introduce a prohibition on the recognition or enforcement in the Union of injunctions, orders, judgments or other court decisions pursuant to or in relation to Article 248 of the Arbitration Procedure Code of the Russian Federation or equivalent Russian legislation. (10) It is also appropriate to make certain technical amendments to Decision 2014/512/CFSP, including to extend the deadlines applicable to certain derogations needed for divestments from Russia or for Member States’ security of supply of certain petroleum products. Operators should be aware that Russia is a country where the rule of law is not applied anymore, and that the Russian Federation has adopted several pieces of legislation targeting assets of companies from unfriendly countries, including Member States. That could lead to Union assets being stranded in Russia without the possibility for orderly withdrawal. Because of the risks of maintaining business activities in Russia, Union operators should consider winding down businesses in Russia and/or not to start new businesses there. The exceptional extension of the divestment derogations is necessary to enable Union operators to exit as swiftly as possible from the Russian market. The extended derogations are granted on a case-by-case-basis by Member States and focused on allowing an orderly divestment process, which would not be possible without the extension of these deadlines.

(11) Further action by the Union is needed in order to implement certain measures. (12) Decision 2014/512/CFSP should therefore be amended accordingly, HAS ADOPTED THIS DECISION:

Article 1

Decision 2014/512/CFSP is amended as follows: (1) in Article 1a, the following paragraph is added: 12. Actions by a central securities depository carried out in good faith pursuant to paragraphs (4) to (11) on the basis that such actions are in accordance with this Decision shall not give rise to liability of any kind on the part of that depository, or of its directors or employees, unless it is proved that the action was a result of negligence. ; (2) Article 1aa is amended as follows: (a) in paragraph 3, point (d) is replaced by the following: (d) transactions, including sales, which are strictly necessary for the wind-down, by 31 December 2025, of a joint venture or similar legal arrangement concluded before 16 March 2022, involving a legal person, entity or body referred to in paragraph 1; ; (b) paragraph 3a is replaced by the following: 3a. By way of derogation from paragraph 1, the competent authorities may authorise, under such conditions as they deem appropriate, transactions which are strictly necessary for the divestment and withdrawal by 31 December 2025, by the entities referred to in paragraph 1 or their subsidiaries in the Union from a legal person, entity or body established in the Union. ; (3) Article 4o is amended as follows: (a) in paragraph 6, the introductory wording is replaced by the following: 6. As of 5 February 2023, and by way of derogation from paragraphs 1 and 2, the competent authorities of Croatia may authorise until 31 December 2025 the purchase, import or transfer of vacuum gas oil falling under CN code 2710 19 71 originating in Russia or exported from Russia, provided that the following conditions are fulfilled: ; (b) in paragraph 8, the fourth subparagraph is replaced by the following: By way of temporary derogation, the prohibitions referred to in the third subparagraph shall apply as from 5 June 2025 to the import and transfer into Czechia, and to the sale to purchasers in Czechia, of petroleum products obtained from crude oil which has been delivered by pipeline into another Member State as referred to in paragraph 3, point (d). If alternative supplies for such petroleum products are made available to Czechia before that date, the Council shall terminate that temporary derogation. During the period until 5 June 2025, the volumes of such petroleum products imported into Czechia from other Member States shall not exceed the average volumes imported into Czechia from those other Member States over the same period during the previous five years. ; (4) Article 4r is amended as follows: (a) in paragraph 1, the introductory wording is replaced by the following:

By way of derogation from Articles 3, 3a, 4, 4c, 4d, 4g, 4j and 4m, the competent authorities may authorise the sale, supply or transfer of goods and technologies listed in Annexes II, VII, X, XI, XVI, XVIII, XX and XXIII to Regulation (EU) No 833/2014 and in Annex I to Regulation (EU) 2021/821 as well as the sale, licensing or transfer in any other way of intellectual property rights or trade secrets as well as granting rights to access or re-use any material or information protected by means of intellectual property rights or constituting trade secrets, related to the goods and technology mentioned above until 31 December 2025, where such sale, supply, transfer, licensing, granting rights to access or re-use is strictly necessary for the divestment from Russia or the wind-down of business activities in Russia, provided that the following conditions are fulfilled:

; (b) paragraph 1a is replaced by the following: 1a. By way of derogation from Article 3, the competent authorities may authorise the sale, supply or transfer of goods and technologies listed in Annex II to Regulation (EU) No 833/2014 until 31 December 2025, where such sale, supply or transfer is strictly necessary for the divestment from a joint venture incorporated or constituted under the law of a Member State before 24 February 2022, involving a Russian legal person, entity or body, and operating a gas pipeline infrastructure between Russia and third countries. ; (c) in paragraph 2, the introductory wording is replaced by the following: 2. By way of derogation from Articles 4i and 4k, the competent authorities may authorise the import or transfer of goods listed in Annexes XVII and XXI to Regulation (EU) No 833/2014 until 31 December 2025, where such import or transfer is strictly necessary for the divestment from Russia or the wind-down of business activities in Russia, provided that the following conditions are fulfilled: ; (d) in paragraph 2a, the introductory wording is replaced by the following: 2a. By way of derogation from Article 1k, the competent authorities may authorise the continuation of the provision of services listed therein until 31 December 2025 where such provision of services is strictly necessary for the divestment from Russia or the wind-down of business activities in Russia, provided that the following conditions are fulfilled: ; (5) in Article 4x(2), point (b) is replaced by the following: (b) transport crude oil or petroleum products, as listed in Annex XIII, that originate in Russia or are exported from Russia while practicing irregular and high-risk shipping practices as set out in the International Maritime Organisation General Assembly resolution A.1192(33); ; (6) in Article 7, paragraph 4 is replaced by the following: 4. By way of derogation from paragraph 1, the competent authorities, based on a specific and case-by-case assessment, may authorise, until 31 December 2025, the satisfaction of a claim made by one of the persons, entities and bodies indicated in paragraph 1, point (b), under such conditions as the competent authorities deem appropriate and after having determined that the satisfaction of the claim is strictly necessary for the divestment from Russia or the wind-down of business activities in Russia. ; (7) the following article is inserted:

Article 7a

No injunction, order, relief, judgment or other court decision pursuant to or derived from Article 248 of the Arbitration Procedure Code of the Russian Federation or equivalent Russian legislation shall be recognised, given effect or enforced in a Member State.
No request for assistance during an investigation or other criminal proceedings, and no punishment or other sanction pursuant to the Russian Criminal Code, based on an alleged violation of an injunction, order, relief, judgment or other court decision pursuant or derived from Article 248 of the Arbitration Procedure Code of the Russian Federation or equivalent Russian legislation shall be recognised, given effect or enforced in a Member State..

Article 2

Annexes IV and XVI to Decision 2014/512/CFSP are amended in accordance with the Annex to this Decision.
