Commission Implementing Decision (EU) 2025/2054 of 13 October 2025 reducing from European Union financing certain expenditure incurred by the Member States under the European Agricultural Guarantee Fund (EAGF) and under the European Agricultural Fund for Rural Development (EAFRD) (notified under document C(2025) 6791) (Only the Dutch, French, German, Greek and Spanish texts are authentic) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2021/2116 of the European Parliament and of the Council of 2 December 2021 on the financing, management and monitoring of the common agricultural policy and repealing Regulation (EU) No 1306/2013 OJ L 435, 6.12.2021, p. 187, ELI: http://data.europa.eu/eli/reg/2021/2116/oj. , and in particular Article 54 thereof, After consulting the Committee on the Agricultural Funds, Whereas: (1) In accordance with Article 54(2) of Regulation (EU) 2021/2116, the Commission is to assess the amounts to be reduced, taking into account justifications provided by the Member State in the annual performance reports in accordance with Article 134(8) of Regulation (EU) 2021/2115 of the European Parliament and of the Council Regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 establishing rules on support for strategic plans to be drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD) and repealing Regulations (EU) No 1305/2013 and (EU) No 1307/2013 (OJ L 435, 6.12.2021, p. 1, ELI: http://data.europa.eu/eli/reg/2021/2115/oj). . (2) Only the expenditure falling within the scope of Article 5(2) and Article 6 of the Regulation (EU) 2021/2116, corresponding to the interventions referred to in Title III of Regulation (EU) 2021/2115, and which has a corresponding output as reported in the annual performance report referred to in Article 9(3)(b) and Article 10(1)(b) of Regulation (EU) 2021/2116, and in Article 134 of Regulation (EU) 2021/2115, can be financed by the Union budget. (3) With the amendment of Commission Delegated Regulation (EU) 2022/127 Commission Delegated Regulation (EU) 2022/127 of 7 December 2021 supplementing Regulation (EU) 2021/2116 of the European Parliament and of the Council with rules on paying agencies and other bodies, financial management, clearance of accounts, securities and use of euro (OJ L 20, 31.1.2022, p. 95, ELI: http://data.europa.eu/eli/reg_del/2022/127/oj). by Commission Delegated Regulation (EU) 2025/310 Commission Delegated Regulation (EU) 2025/310 of 5 December 2024 amending delegated regulation (EU) 2022/127 as regards the annual performance clearance and conformity procedure (OJ L, 2025/310, 12.2.2025, ELI: http://data.europa.eu/eli/reg_del/2025/310/oj). , Member States are not required to provide justifications for the purpose of the annual performance clearance for deviations of realised unit amounts from planned unit amounts where the total expenditure corresponding to these deviations does not exceed 2 % of the total expenditure declared in the annual performance report in accordance with Article 134(5), point (b), of Regulation (EU) 2021/2115 for the financial year concerned. However, Member States must provide justifications for all excesses of realised unit amounts from maximum (average) planned unit amounts.

(4) In the light of the assessment carried out, and taking into account the Member States’ justifications, the part of the expenditure referred to in Article 5(2) and Article 6 of Regulation (EU) 2021/2116 and corresponding to the interventions referred to in Title III of Regulation (EU) 2021/2115, which does not have a corresponding output as reported in the annual performance report referred to in Article 9(3)(b) and Article 10(1)(b) of Regulation (EU) 2021/2116 and in Article 134 of Regulation (EU) 2021/2115, should be reduced from Union financing. (5) As regards the interventions covered by this decision, the assessment of the amounts to be reduced on grounds of non-compliance with Union law is notified by the Commission to the Member States in the summary report on the subject Ares(2025)7793398. , HAS ADOPTED THIS DECISION:

Article 1

The amounts set out in the Annex and related to expenditure declared by the Member States’ accredited paying agencies under the EAGF or the EAFRD, corresponding to the interventions referred to in Title III of Regulation (EU) 2021/2115 and which does not have a corresponding output as reported in the annual performance report referred to in Article 9(3)(b) and Article 10(1)(b) of Regulation (EU) 2021/2116 and in Article 134 of Regulation (EU) 2021/2115, shall be reduced from Union financing.

This Decision is addressed to the Kingdom of Belgium, the Federal Republic of Germany, the Hellenic Republic, the Kingdom of Spain, the French Republic, the Republic of Cyprus and the Kingdom of the Netherlands.
