Commission Implementing Regulation (EU) 2025/826 of 29 April 2025 correcting Implementing Regulation (EU) 2025/261 imposing a definitive anti-dumping duty on imports of biodiesel originating in the People’s Republic of China THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union OJ L 176, 30.6.2016, p. 21. (the basic Regulation) and in particular Article 9 and Article 14(1) thereof, Whereas: (1) By Commission Implementing Regulation (EU) 2025/261 Commission Implementing Regulation (EU) 2025/261 of 10 February 2025 imposing a definitive anti-dumping duty on imports of biodiesel originating in the People’s Republic of China (OJ L, 2025/261, 11.2.2025, ELI: http://data.europa.eu/eli/reg_impl/2025/261/oj). , the European Commission imposed a definitive anti-dumping duty on imports of biodiesel originating in the People’s Republic of China. (2) As noted in recital 252 of Implementing Regulation (EU) 2025/261, the Commission comitted to monitor biodiesel and sustainable aviation fuels (SAF) flows after the imposition of anti-dumping measures on Chinese biodiesel. Therefore, separate TARIC codes were established for SAF as defined in Article 1 of this Implementing Regulation and originating in the People’s Republic of China for monitoring purpose. However, to better monitor sustainable aviation fuels, additional TARIC codes should be added to CN codes 27101911, 27101915, 27101921, 27101925 and 27101929. (3) In view of the above, it is considered necessary to amend the original Regulation to include additional TARIC codes in its Article 1(1). (4) The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 15(1) Regulation (EU) 2016/1036, HAS ADOPTED THIS REGULATION:

Article 1

Article 1 paragraph 1 of Implementing Regulation (EU) 2025/261 is replaced by the following:

1. A definitive anti-dumping duty is imposed on imports of fatty-acid mono-alkyl esters and/or paraffinic gasoils obtained from synthesis and/or hydro-treatment, of non-fossil origin, commonly known as biodiesel, in pure form or as included in a blend, currently falling under CN codes ex15162098 (TARIC codes 1516209821, 1516209822, 1516209823, 1516209829, 1516209831, 1516209832 and 1516209839), ex15180091 (TARIC codes 1518009121, 1518009122, 1518009123, 1518009129, 1518009131, 1518009132 and 1518009139), ex15180095 (TARIC code 1518009510, 1518009511 and 1518009519), ex15180099 (TARIC codes 1518009921, 1518009922, 1518009923, 1518009929, 1518009931, 1518009932 and 1518009939), ex27101942 (TARIC codes 2710194221, 2710194222, 2710194223 and 2710194229), ex27101944 (TARIC codes 2710194421, 2710194422, 2710194423, 2710194429, 2710194431, 2710194432 and 2710194439), ex27101946 (TARIC codes 2710194621, 2710194622, 2710194623, 2710194629, 2710194631, 2710194632 and 2710194639), ex27101947 (TARIC codes 2710194721, 2710194722, 2710194723, 2710194729, 2710194731, 2710194732 and 2710194739), 27102011, 27102016, ex38249992 (TARIC codes 3824999210, 3824999211, 3824999213, 3824999214, 3824999215, 3824999216, and 3824999219), 38260010 and ex38260090 (95) (TARIC codes 3826009011, 3826009012, 3826009013, 3826009019, 3826009031, 3826009032 and 3826009039), excluding sustainable aviation fuels meeting the requirements of ASTM D7566-22 Standard Specification for Aviation Turbine Fuel Containing Synthesized Hydrocarbons, currently falling under CN codes ex27101942 (TARIC additional code 89FT), ex27101944 (TARIC additional code 89FT), ex27101946 (TARIC additional code 89FT), ex27101947 (TARIC additional code 89FT), ex27102011 (TARIC additional code 89FT) and ex27102016 (TARIC additional code 89FT), and originating in the People’s Republic of China. In order to monitor imports of sustainable aviation fuels, in addition to the codes mentioned in this paragraph which were excluded from the scope of the measure, the following TARIC additional codes shall be subject to monitoring: CN codes 27101911 (TARIC additional code 89FT), 27101915 (TARIC additional code 89FT), 27101921 (TARIC additional code 89FT), 27101925 (TARIC additional code 89FT) and 27101929 (TARIC additional code 89FT).

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
