Commission Delegated Regulation (EU) 2025/1280 of 21 May 2025 amending Commission Delegated Regulation (EU) 2023/370 supplementing Regulation (EU) 2021/2115 of the European Parliament and of the Council as regards the time period to submit requests for amendments of CAP Strategic Plans THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 establishing rules on support for strategic plans to be drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD) and repealing Regulations (EU) No 1305/2013 and (EU) No 1307/2013 OJ L 435, 6.12.2021, p. 1, ELI http://data.europa.eu/eli/reg/2021/2115/oj. , and in particular Article 122, point (a), thereof, Whereas: (1) Commission Delegated Regulation (EU) 2023/370 Commission Delegated Regulation (EU) 2023/370 of 13 December 2022 supplementing Regulation (EU) 2021/2115 of the European Parliament and of the Council with regard to procedures, time limits for submission by Member States of requests for amendments of CAP Strategic Plans, and further cases for which the maximum number of amendments of CAP Strategic Plans does not apply (OJ L 51, 20.2.2023, p. 25, ELI: http://data.europa.eu/eli/reg_del/2023/370/oj). lays down rules on the time limits for submission of requests for amendments of CAP Strategic Plans. In particular, Article 3(4) of that Delegated Regulation sets out the time period for the submission of requests for amendment relating to transfers referred to in Article 17(5), Article 88(7) and Article 103 of Regulation (EU) 2021/2115. Such requests are to be submitted by Member States between 1 January 2025 and 31 May 2025. (2) In the current context of ongoing instability in the agricultural sector across the Union, several Member States are experiencing difficulties in deciding already in the early months of 2025 on the need to review their transfer decisions taken in 2022 pursuant to Article 17(5), Article 88(6) and Article 103 of Regulation (EU) 2021/2115. Therefore, it is considered necessary to provide Member States with more time to plan these transfers and thus postpone the deadline of 31 May 2025 to 31 August 2025. (3) Delegated Regulation (EU) 2023/370 should therefore be amended accordingly. (4) Since the time period laid down in Article 3(4) of Delegated Regulation (EU) 2023/370 is approaching its end and is to expire on 31 May 2025, it is of utmost importance to establish the new time period for submission of requests for amendment as soon as possible to allow for appropriate planning and consideration by Member States. This Regulation should therefore enter into force on the day following that of its publication in the Official Journal of the European Union. (5) Considering that the time period for submission of requests for amendment ends on 31 May 2025, this Regulation should apply as of 1 June 2025 to avoid the occurrence of a legal gap between the current and the amended period for submission,

HAS ADOPTED THIS REGULATION:

Article 1

In Article 3 of Delegated Regulation (EU) 2023/370, paragraph 4 is replaced by the following: 4. Requests for amendment relating to transfers referred to in Article 17(5), Article 88(7) and Article 103 of Regulation (EU) 2021/2115 shall be submitted to the Commission during the period between 1 January 2025 and 31 August 2025..

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union. It shall apply from 1 June 2025.
