Commission Regulation (EU) 2025/2006 of 18 December 2025 correcting and amending Regulation (EU) 2023/1670 laying down ecodesign requirements for smartphones, mobile phones other than smartphones, cordless phones and slate tablets pursuant to Directive 2009/125/EC of the European Parliament and of the Council (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Directive 2009/125/EC of the European Parliament and of the Council of 21 October 2009 establishing a framework for the setting of ecodesign requirements for energy-related products OJ L 285, 31.10.2009, p. 10, ELI: http://data.europa.eu/eli/dir/2009/125/oj. , and in particular Article 15(1) thereof, Whereas: (1) Commission Regulation (EU) 2023/1670 Commission Regulation (EU) 2023/1670 laying down ecodesign requirements for smartphones, mobile phones other than smartphones, cordless phones and slate tablets pursuant to Directive 2009/125/EC of the European Parliament and of the Council and amending Commission Regulation (EU) 2023/826 (OJ L 214, 31.08.2023, p. 10, ELI: http://data.europa.eu/eli/reg/2023/1670/oj). establishes ecodesign requirements for smartphones, mobile phones other than smartphones, cordless phones and slate tablets. (2) Directive 2014/34/EU of the European Parliament and of the Council Directive 2014/34/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to equipment and protective systems intended for use in potentially explosive atmospheres OJ L 96, 29.3.2014, pp. 309–356, ELI: http://data.europa.eu/eli/dir/2014/34/oj. introduces specific design requirements for equipment and protective systems intended for use in potentially explosive atmospheres. Therefore, smartphones, other mobile phones, cordless phones and slate tablets covered by that Directive should be exempted from Regulation (EU) 2023/1670. (3) Annex II to Regulation (EU) 2023/1670 requires that a range of spare parts are made available to professional repairers or end users, and it establishes two different maximum delivery timelines of those spare parts: five working days during the first five years and ten working days during the remaining two years. However, the obligation to provide spare parts may last longer than seven years. Therefore, this error needs to be corrected. Given that the error affects all products covered by the Regulation, the same correction has to be made for each product group inparts A to D, section 1.1, point (3), of that Annex. (4) Annex II to Regulation (EU) 2023/1670 establishes different disassembly requirements for various parts of the product. There is an error regarding the requirements for the replacement of the display assembly, which was erroneously included in two separate sections of the requirements. For clarity and consistency this error in parts A, B and D, section 1.1, point (5), of that Annex, needs to be rectified. The same applies to part C, section 2.1, point (5) where the display assembly is included in both points (a) and (c); therefore, point (c) needs to be deleted.

(5) Article 40 paragraphs 1 to 4 of Regulation (EU) 2024/1781 of the European Parliament and of the Council Regulation (EU) 2024/1781 of the European Parliament and of the Council of 13 June 2024 establishing a framework for the setting of ecodesign requirements for sustainable products, amending Directive (EU) 2020/1828 and Regulation (EU) 2023/1542 and repealing Directive 2009/125/EC (OJ L, 2024/1781, 28.6.2024, ELI: http://data.europa.eu/eli/reg/2024/1781/oj). tackles circumvention in a comprehensive manner and applies to products covered by Regulation (EU) 2023/1670 since the entry into application of Regulation (EU) 2024/1781. Therefore Article 6 of Regulation (EU) 2023/1670 has become redundant and should be deleted. (6) Regulation (EU) 2023/1670 should therefore be corrected and amended accordingly. (7) This Regulation should apply from 20 June 2025 in order to provide legal certainty with regard to the date of application of the ecodesign requirements under Regulation (EU) 2023/1670. (8) The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 19(1) of Directive 2009/125/EC, HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EU) 2023/1670 is amended as follows: (1) In Article 1(2) the following point is added: (c) smartphones, other mobile phones, cordless phones and slate tablets intended for use in potentially explosive atmospheres and covered by Directive 2014/34/EU. (2) Article 6 is deleted. (3) In Article 9 the last paragraph is replaced by the following: other equipment for the purpose of recording or reproducing sound or images, including signals or other technologies for the distribution of sound and image other than by telecommunications, but excluding electronic displays covered by Regulation (EU) 2019/2021, cordless phones covered by Regulation (EU) 2023/1670, and projectors with mechanisms for exchanging the lenses with others with different focal length..

Article 2

Annex II and IV to Regulation (EU) 2023/1670 are corrected in accordance with the Annex to this Regulation.

Article 3

This Regulation shall enter into force on the twentieth day following its publication in the Official Journal of the European Union. It shall apply from 20 June 2025. ANNEX Annex II and Annex IV to Regulation (EU) 2023/1670 are corrected as follows: A. Annex II is corrected as follows: (1) In Part A, section 1.1, is corrected as follows: (a) in point (3), point (a) is replaced by the following: (a) manufacturers, importers or authorised representatives shall ensure that: (i) during the first 5 years of the period referred to in points 1(a) and (c), spare parts are delivered within 5 working days after having received the order; (ii) during the remaining years of the period referred to in points 1(a) and (c), spare parts are delivered within 10 working days after having received the order.

(b) in point (5), point (b) is replaced by the following: (b) From 20 June 2025, manufacturers, importers or authorised representatives shall ensure that the process for replacement of parts referred to in point 1(c), with the exception of the battery or batteries and the display assembly, meets the following criteria: (i) fasteners shall be removable, resupplied or reusable; (ii) the process for replacement shall be feasible with no tool, a tool or set of tools that is supplied with the product or spare part, or basic tools; (iii) the process for replacement shall be able to be carried out in a use environment; (iv) the process for replacement shall be able to be carried out by a layman. (2) In part B, section 1.1, is corrected as follows: (a) in point (3), point (a) is replaced by the following: (a) manufacturers, importers or authorised representatives shall ensure that: (i) during the first 5 years of the period referred to in points 1(a) and (c), spare parts are delivered within 5 working days after having received the order; (ii) during the remaining years of the period referred to in points 1(a) and (c), spare parts are delivered within 10 working days after having received the order. Annex IV is corrected as follows: Paragraph 2 is replaced by the following: Where a model is not in conformity with the requirements laid down in Article 40 paragraphs 1 to 4 of Regulation (EU) 2024/1781, the model and all equivalent models shall be considered not compliant.
