Commission Implementing Regulation (EU) 2025/2230 of 29 October 2025 amending Implementing Regulation (EU) No 1352/2013 as regards the types of intellectual property rights included in the application form for customs action THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 608/2013 of the European Parliament and of the Council of 12 June 2013 concerning customs enforcement of intellectual property rights and repealing Council Regulation (EC) No 1383/2003 OJ L 181, 29.6.2013, p. 15, ELI: http://data.europa.eu/eli/reg/2013/608/oj. , and in particular Article 6(1) thereof, After consulting the Customs Code Committee, Whereas: (1) Commission Implementing Regulation (EU) No 1352/2013 Commission Implementing Regulation (EU) No 1352/2013 of 4 December 2013 establishing the forms provided for in Regulation (EU) No 608/2013 of the European Parliament and of the Council concerning customs enforcement of intellectual property rights (OJ L 341, 18.12.2013, p. 10, ELI: http://data.europa.eu/eli/reg_impl/2013/1352/oj). establishes in its Annex I the standard form to be used for a request to the customs authorities to take action with respect to goods suspected of infringing an intellectual property right (the application form), as referred to in Article 6 of Regulation (EU) No 608/2013. (2) In box 5 of the application form, the applicant is to indicate the type of intellectual property right(s) to which the application refers. As some types of intellectual property rights have been updated by means of legal acts listed below, it is necessary to update these types of intellectual property rights in the application form. (3) Regulation (EU) 2024/2822 of the European Parliament and of the Council Regulation (EU) 2024/2822 of the European Parliament and of the Council of 23 October 2024 amending Council Regulation (EC) No 6/2002 on Community designs and repealing Commission Regulation (EC) No 2246/2002 (OJ L, 2024/2822, 18.11.2024, ELI: http://data.europa.eu/eli/reg/2024/2822/oj). updated the terms registered Community design and unregistered Community design to the terms registered EU design and unregistered EU design respectively. Box 5 of the application form should therefore be updated accordingly. (4) Pursuant to Regulation (EU) 2024/1143 of the European Parliament and of the Council Regulation (EU) 2024/1143 of the European Parliament and of the Council of 11 April 2024 on geographical indications for wine, spirit drinks and agricultural products, as well as traditional specialities guaranteed and optional quality terms for agricultural products, amending Regulations (EU) No 1308/2013, (EU) 2019/787 and (EU) 2019/1753 and repealing Regulation (EU) No 1151/2012 (OJ L, 2024/1143, 23.4.2024, ELI: http://data.europa.eu/eli/reg/2024/1143/oj). , the term for agricultural products and foodstuff was updated to for agricultural products. Therefore, that term should be updated under the heading geographical indication/designation of origin in box 5 of the application form.
(5) Following the entry into force of Regulation (EU) 2021/2117 of the European Parliament and of the Council Regulation (EU) 2021/2117 of the European Parliament and of the Council of 2 December 2021 amending Regulations (EU) No 1308/2013 establishing a common organisation of the markets in agricultural products, (EU) No 1151/2012 on quality schemes for agricultural products and foodstuffs, (EU) No 251/2014 on the definition, description, presentation, labelling and the protection of geographical indications of aromatised wine products and (EU) No 228/2013 laying down specific measures for agriculture in the outermost regions of the Union (OJ L 435, 6.12.2021, p. 262, ELI: http://data.europa.eu/eli/reg/2021/2117/oj). , it is necessary to delete the designation for aromatised drinks based on wine products from the application form as those products now fall under the category for agricultural products. (6) Regulation (EU) 2023/2411 of the European Parliament and of the Council Regulation (EU) 2023/2411 of the European Parliament and of the Council of 18 October 2023 on the protection of geographical indications for craft and industrial products and amending Regulations (EU) 2017/1001 and (EU) 2019/1753 (OJ L, 2023/2411, 27.10.2023, ELI: http://data.europa.eu/eli/reg/2023/2411/oj). introduced a new system for the protection of geographical indications for craft and industrial products in the Union. As those intellectual property rights fall within the scope of Regulation (EU) No 608/2013, applicants should be able to request customs authorities to take action with respect to goods suspected of infringing those rights. Accordingly, geographical indications for craft and industrial products should be included in the types of rights to which the application refers in box 5 of the application form. (7) Implementing Regulation (EU) No 1352/2013 should therefore be amended accordingly, HAS ADOPTED THIS REGULATION:
Article 1
Implementing Regulation (EU) No 1352/2013 is amended as follows: (1) Annex I is replaced by the text in Annex I to this Regulation; (2) In Annex III, Part I, box 6, sentence 3 is replaced by the following: In case Northern Ireland (XI) is indicated, the application shall be a Union application and can only be granted for protection with respect to any of the following intellectual property rights which are protected in Northern Ireland by virtue of Windsor Framework: (a) geographical indications or designations of origin protected for agricultural products and wines, as well as geographical indications protected for spirit drinks, as provided for in Regulation (EU) 2024/1143 of the European Parliament and of the Council; (b) geographical indications for craft and industrial products as provided for in Regulation (EU) 2023/2411 of the European Parliament and of the Council. The Windsor Framework is the new way in which the Protocol on Ireland / Northern Ireland is referred to in accordance with Joint Declaration No 1/2023 of the Union and the United Kingdom in the Joint Committee established by the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community of 24 March 2023, OJ L 102, 17.4.2023, p. 87.

Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
