Commission Implementing Regulation (EU) 2025/2581 of 18 December 2025 amending Implementing Regulation (EU) 2025/2144 making imports of pea protein originating in the People’s Republic of China subject to registration THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union OJ L 176, 30.6.2016, p. 21, ELI: http://data.europa.eu/eli/reg/2016/1036/oj. and in particular Article 14(5) thereof, After informing the Member States, Whereas: (1) On 29 August 2025, the European Commission (the Commission) published a notice initiating an anti-dumping investigation concerning imports of pea protein originating in the People’s Republic of China OJ C, C/2025/4850, 29.8.2025, ELI: http://data.europa.eu/eli/C/2025/4850/oj. (the Notice of 29 August 2025). (2) On 21 October 2025, by Commission Implementing Regulation (EU) 2025/2144 Commission Implementing Regulation (EU) 2025/2144 of 21 October 2025 making imports of pea protein originating in the People’s Republic of China subject to registration (OJ L, 2025/2144, 22.10.2025, ELI: http://data.europa.eu/eli/reg_impl/2025/2144/oj). , the Commission made imports of pea protein originating in the People’s Republic of China subject to registration. (3) During the investigation, a number of Member States and interested parties brought to the Commission’s attention the fact that the product under investigation can be classified under certain Combined Nomenclature (CN) codes that were not mentioned in the notice of 29 August 2025. The Commission amended the Notice of 29 August 2025 to add those CN codes and the corresponding TARIC codes. (4) Imports under those CN and TARIC codes should also be subject to registration. Therefore, Article 1 of Implementing Regulation (EU) 2025/2144 should be amended, HAS ADOPTED THIS REGULATION:

Article 1 of Implementing Regulation (EU) 2025/2144 shall be replaced as follows:

The customs authorities are hereby directed, under Article 14(5) of Regulation (EU) 2016/1036, to take the appropriate steps to register imports into the Union of high protein content pea protein, which contains more than 65 percent protein on a dry weight basis, encompassing all types of pea protein derived from peas (including, but not limited to, yellow field peas and green field peas), in all physical forms (including solid (e.g. powder) and liquid (solution) forms), whether textured or not, currently falling within CN codes: ex35040090 (TARIC code 3504009091), ex21061020 (TARIC code 2106102040), ex21061080 (TARIC codes: 2106108031, 2106108039 and 2106108071), ex21069092 (TARIC codes 2106909275), ex23031090 (TARIC code 2303109010), ex23091011, ex23091013, ex23091015, ex23091019, ex23091031, ex23091033, ex23091039, ex23091051, ex23091053, ex23091059, ex23091070, ex23091090, ex23099010, ex23099020 (TARIC additional code 8G60), ex23099031 (TARIC codes: 2309903112, 2309903114, 2309903117, 2309903119, 2309903130, 2309903151, 2309903159, 2309903161, 2309903169, 2309903181 and 2309903191), ex23099033, ex23099035, ex23099039, ex23099041, ex23099043, ex23099049, ex23099051, ex23099053, ex23099059, ex23099070, ex 2309 90 91(TARIC additional code 8G60), ex23099096 (TARIC codes: 2309909631, 2309909639, 2309909651, 2309909659, 2309909661, 2309909669, 2309909691 and 2309909695) originating in the People’s Republic of China.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
