Commission Implementing Decision (EU) 2026/116 of 19 January 2026 amending Commission Implementing Decision (EU) 2016/2321 on the format of the ready for recycling certificate issued in accordance with Regulation (EU) No 1257/2013 of the European Parliament and of the Council on ship recycling (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC OJ L 330, 10.12.2013, p. 1, ELI: http://data.europa.eu/eli/reg/2013/1257/oj. , and in particular Article 9(9), second subparagraph, thereof, Whereas: (1) The format of the ready for recycling certificate is set out in Commission Implementing Decision (EU) 2016/2321. Commission Implementing Decision (EU) 2016/2321 of 19 December 2016 on the format of the ready for recycling certificate issued in accordance with Regulation (EU) No 1257/2013 of the European Parliament and of the Council on ship recycling (OJ L 345, 20.12.2016, p. 112, ELI: http://data.europa.eu/eli/dec_impl/2016/2321/oj). It was developed to be consistent with Appendix 4 to the International Convention for the Safe and Environmentally Sound Recycling of Ships adopted in Hong Kong on 15 May 2009 (the Hong Kong Convention). (2) Following the entry into force of the Hong Kong Convention on 26 June 2025, it should be ensured that the format of the ready for recycling certificate issued under Regulation (EU) No 1257/2013 can be used both under the Hong Kong Convention and under Regulation (EU) No 1257/2013 for legal certainty and administrative simplification. (3) The measures provided for in this Decision are in accordance with the opinion of the committee established by Article 25 of Regulation (EU) No 1257/2013, HAS ADOPTED THIS DECISION:

The Annex to Implementing Decision (EU) 2016/2321 is replaced by the text in the Annex to this Decision.
Article 2

Note: The ship recycling plan, as required by regulation 9 of the Annex to the Hong Kong Convention and Article 9(9) of Regulation (EU) No 1257/2013, is an essential part of the International Ready for Recycling Certificate and must always accompany that certificate. THIS IS TO CERTIFY:
- that the ship has been surveyed in accordance with regulation 10 of the Annex to the Hong Kong Convention, for those Member States that are Parties to the Hong Kong Convention, and with Article 8 of Regulation (EU) No 1257/2013;
- that the ship has a valid inventory of hazardous materials in accordance with regulation 5 of the Annex to the Hong Kong Convention, for those Member States that are Parties to the Hong Kong Convention, and with Article 5(7) of Regulation (EU) No 1257/2013;
- that the ship recycling plan, as required by regulation 9 of the Annex to the Hong Kong Convention properly reflects the information contained in the inventory of hazardous materials as required by regulation 5.4 of the Annex to the Hong Kong Convention and contains information concerning the establishment, maintenance and monitoring of Safe-for-entry and Safe-for-hot work conditions, for those Member States that are Parties to the Hong Kong Convention;
- that the ship recycling plan was compiled in accordance with Article 7(2) of Regulation (EU) No 1257/2013; and
- that the ship recycling facility(ies) where this ship is to be recycled holds a valid authorization in accordance with the Hong Kong Convention, for those Member States that are Parties to the Hong Kong Convention, and is listed in the European List in accordance with Article 16 of Regulation (EU) No 1257/2013.
