Commission Implementing Decision (EU) 2026/284 of 6 February 2026 amending Implementing Decision (EU) 2019/451 on the harmonised standards for construction products drafted in support of Regulation (EU) No 305/2011 of the European Parliament and of the Council (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC OJ L 88, 4.4.2011, p. 5, ELI: http://data.europa.eu/eli/reg/2011/305/oj. , and in particular Article 17(5) thereof, Whereas: (1) In accordance with Regulation (EU) No 305/2011, manufacturers are to use the methods and the criteria provided in harmonised standards, the references of which have been published in the Official Journal of the European Union, for assessing the performance of construction products covered by those standards in relation to their essential characteristics. (2) By Commission Implementing Decision C(2021) 5359 Commission Implementing Decision C(2021) 5359 of 29 July 2021 on a standardisation request to the European Committee for Standardisation as regards space heating appliances in support of Regulation (EU) No 305/2011 of the European Parliament and of the Council. as amended by Commission Implementing Decision C(2025) 455 Commission Implementing Decision C(2025) 455 of 28 January 2025 amending Implementing Decision C(2021) 5359 as regards harmonised standards for space heating appliances and the deadlines for the adoption of those standards. , the Commission made a request to the European Committee for Standardization (CEN) for the drafting and revision of harmonised standards in support of Regulation (EU) No 305/2011 for space heating appliances. (3) On the basis of the request set out in Implementing Decision C(2021) 5359 as amended by Implementing Decision C(2025) 455, CEN revised harmonised standards EN 1:1998/A1:2007 and EN 1:1998 – Flued oil stoves with vaporizing burners; EN 15250:2007 – Slow heat release appliances fired by solid fuel – Requirements and test methods; and EN 15821:2010 – Multi-firing sauna stoves fired by natural wood logs – Requirements and test methods. The references of those standards are published in the C series of the Official Journal of the European Union Commission communication in the framework of the implementation of Regulation (EU) No 305/2011 of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (Publication of titles and references of harmonised standards under Union harmonisation legislation). The provisions of Regulation (EU) No 305/2011 prevail over any conflicting provisions in the harmonised standards (OJ C 92, 9.3.2018, p. 139). . (4) The revision of those standards resulted in the adoption of revised harmonised standards EN 1-2:2025 – Residential liquid fuel burning appliances – Part 2: Flued oil stoves with vaporizing burners; EN 16510-2-5:2025 – Residential solid fuel burning appliances – Part 2-5: Slow heat release appliances; and EN 16510-2-10:2025 – Residential solid fuel burning appliances – Part 2-10: Multi-firing sauna stoves fired by natural wood logs.
(5) On the basis of the request set out in Implementing Decision C(2021) 5359 as amended by Implementing Decision C(2025) 455, CEN adopted new harmonised standard EN 16510-2-7:2025 – Residential solid fuel burning appliances – Part 2-7: Combination appliances fired by wood logs and pellets. (6) The Commission has assessed whether the three revised harmonised standards and the new harmonised standard adopted by CEN comply with the request set out in Implementing Decision C(2021) 5359 and with Regulation (EU) No 305/2011. (7) The three harmonised standards revised and the new harmonised standard adopted by CEN are in conformity with Implementing Decision C(2021) 5359 as amended by Implementing Decision C(2025) 455 and Regulation (EU) No 305/2011. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union. (8) Considering that Residential solid fuel burning appliances – Combination appliances fired by wood logs and pellets are covered by the scope of two standards, EN 13240:2001 Roomheaters fired by solid fuel – Requirements and test methods (including its amendments) and EN 14785:2006 – Residential space heating appliances fired by wood pellets – Requirements and test methods, and that they were CE marked in accordance with both of them, it should be clarified that these harmonised standards remain applicable to these products until the end of the coexistence period of EN 16510-2-7:2025 as regards the obligations established under Regulation (EU) No 305/2011. (9) By letter M/122 of 6 July 1998, the Commission made a request to the European Committee for Standardization (CEN) for the drafting of harmonised standards in support of Council Directive 89/106/EEC Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products (OJ L 40, 11.2.1989, p. 12, ELI: http://data.europa.eu/eli/dir/1989/106/oj). (the mandate). The mandate allows for the adoption of harmonised standards drafted on its basis, in particular for permanent anchor devices and safety hooks. (10) On the basis of the mandate, CEN drafted a new harmonised standard EN 17235:2024 for permanent anchor devices and safety hooks. (11) Commission Delegated Regulation (EU) 2025/695 Commission Delegated Regulation (EU) 2025/695 of 9 April 2025 supplementing Regulation (EU) No 305/2011 of the European Parliament and of the Council by establishing threshold levels and classes of performance for permanent anchor devices and safety hooks (OJ L, 2025/695, 22.7.2025, ELI: http://data.europa.eu/eli/reg_del/2025/695/oj). establishes the threshold levels and classes of performance for permanent anchor devices and safety hooks applicable to products covered by EN 17235:2024 Permanent anchor devices and safety hooks. (12) The Commission has assessed whether EN 17235:2024 is in conformity with the mandate, Delegated Regulation (EU) 2025/695 and Regulation (EU) No 305/2011.
(13) The harmonised standard EN 17235:2024 adopted by CEN is in conformity with the relevant mandate, Delegated Regulation (EU) 2025/695 and Regulation (EU) No 305/2011. It is therefore appropriate to publish the reference of that standard in the Official Journal of the European Union. (14) Annex I to Commission Implementing Decision (EU) 2019/451 Commission Implementing Decision (EU) 2019/451 of 19 March 2019 on the harmonised standards for construction products drafted in support of Regulation (EU) No 305/2011 of the European Parliament and of the Council (OJ L 77, 20.3.2019, p. 80, ELI: http://data.europa.eu/eli/dec_impl/2019/451/oj). lists the references of harmonised standards drafted in support of Regulation (EU) No 305/2011. In order to ensure that references of those standards are listed in one act, the references of the harmonised standards EN 1-2:2025; EN 16510-2-10:2025; EN 16510-2-5:2025; EN 16510-2-7:2025 and EN 17235:2024 should be included in that Annex. (15) In accordance with Article 17(5) of Regulation (EU) No 305/2011, a coexistence period is to be indicated for each harmonised standard that supersedes another harmonised standard. (16) Implementing Decision (EU) 2019/451 should therefore be amended accordingly. (17) In order to allow the manufacturers to use the revised harmonised standard as soon as possible, this Decision should enter into force on the day of its publication in the Official Journal of the European Union, HAS ADOPTED THIS DECISION:
Article 1
Annex I to Implementing Decision (EU) 2019/451 is amended in accordance with the Annex to this Decision.
Article 2
