Commission Implementing Decision (EU) 2026/448 of 27 February 2026 amending Implementing Decision (EU) 2016/2323 as regards updates to the European List of ship recycling facilities (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC OJ L 330, 10.12.2013, p. 1, ELI: http://data.europa.eu/eli/reg/2013/1257/oj. , and in particular Article 16(4) thereof, Whereas: (1) Article 6(2), point (a), of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities (European List) published pursuant to Article 16(2) of that Regulation. (2) The European List is set out in Commission Implementing Decision (EU) 2016/2323 Commission Implementing Decision (EU) 2016/2323 of 19 December 2016 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council on ship recycling (OJ L 345, 20.12.2016, p. 119, ELI: http://data.europa.eu/eli/dec_impl/2016/2323/oj). . (3) The expiry date for the inclusion in the European List of UAB APK, a ship recycling facility located in Lithuania, is 12 March 2025. The Commission has received information from the competent authorities in Lithuania that the authorisation to conduct ship recycling granted to that facility has been renewed for a period of five years prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The competent authorities also notified new maximum ship dimensions that the facility can accept. The European List should therefore be updated to reflect those changes. (4) The expiry date for the inclusion in the European List of DDR VESSELS XXI, S.L., a ship recycling facility located in Spain, is 28 July 2025. The Commission has received information from the competent authorities in Spain that the authorisation to conduct ship recycling granted to that facility has been renewed for a period of five years in accordance with Article 14 of Regulation (EU) No 1257/2013. The European List should therefore be updated to reflect that change. (5) The expiry date for the inclusion in the European List of Metruna OÜ, a ship recycling facility located in Estonia, is 15 February 2026. The Commission has received information from the competent authorities in Estonia that the authorisation to conduct ship recycling granted to that facility has been renewed for a period of five years prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The European List should therefore be updated to reflect that change. (6) The expiry date for the inclusion in the European List of Smedegaarden A/S, a ship recycling facility located in Denmark, is 11 March 2026. The Commission has received information from the competent authorities in Denmark that the authorisation to conduct ship recycling granted to that facility has been renewed for a period of five years prior to its expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. The European List should therefore be updated to reflect that change.

(7) The competent authorities in Germany have informed the Commission that the new ship recycling facility EWD Benli Recycling GmbH & Co. KG located in Germany has been authorised in accordance with Article 14 of Regulation (EU) No 1257/2013. The competent authorities have provided the Commission with all information relevant for that facility to be included in the European List. EWD Benli Recycling GmbH & Co. KG should therefore be included in the European List. (8) The expiry date for the inclusion in the European List of Harland and Wolff (Belfast) Ltd, a ship recycling facility located in Northern Ireland, is 16 June 2025. The Commission was informed by the competent authorities in United Kingdom-Northern Ireland that the owner of the ship recycling facility changed. However, the Commission did not receive information about the renewal of the authorisation in accordance with Article 14 of Regulation (EU) No 1257/2013. Harland and Wolff (Belfast) Ltd should therefore be removed from the European List. (9) The expiry date for the inclusion in the European List of Turun Korjaustelakka Oy (Turku Repair Yard Ltd), a ship recycling facility located in Finland, is 14 December 2025. The competent authority in Finland informed the Commission that the authorisation will not be renewed upon request of the facility. Turun Korjaustelakka Oy (Turku Repair Yard Ltd) should therefore be removed from the European List. (10) The expiry date for the inclusion in the European List of Avsar Gemi Söküm San. Dis Tic. Ltd. Şti., a ship recycling facility located in Türkiye, is 2 December 2025. The Commission has received information from the facility that they wish to renew their inclusion in the European List in accordance with Article 15 of Regulation (EU) No 1257/2013. Having assessed the information and supporting evidence provided and gathered in accordance with Article 15 of Regulation (EU) No 1257/2013, including through inspection, the Commission considers that the facility complies with the requirements set out in Article 13 of that Regulation to conduct ship recycling and to be included in the European List. The European List should therefore be updated to reflect that change. (11) The Commission has carried out an inspection of Dortel Gemi Söküm Demir Celik Sanayi Ve Tic Ltd. Şti., a ship recycling facility located in Turkiye, in accordance with Article 15(4) of Regulation (EU) No 1257/2013, which could not confirm that the facility in question continues to comply with the relevant requirements of Article 13(1), in particular point (g) of that Article. The facility cut the primary hull while on the shoreline without impermeable floor and without the use of a slag collector. Furthermore, the facility did not take sufficient measures to collect and contain all waste material generated during the ship recycling process for preventing its escape to the sea and the surroundings. Dortel Gemi Söküm Demir Celik Sanayi Ve Tic Ltd. Şti. should therefore be removed from the European List.

(12) Implementing Decision (EU) 2016/2323 should therefore be amended accordingly. (13) The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25 of Regulation (EU) No 1257/2013, HAS ADOPTED THIS DECISION:

The Annex to Implementing Decision (EU) 2016/2323 is replaced by the text in the Annex to this Decision.

Article 2
