(2) By letter M/396 of 19 December 2006, the Commission made a request to the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) (the first request), for the drafting, the revision and the completion of the work on harmonised standards in support of Directive 2006/42/EC to take account of changes introduced by that Directive in comparison with Directive 98/37/EC of the European Parliament and of the Council Directive 98/37/EC of the European Parliament and of the Council of 22 June 1998 on the approximation of the laws of the Member States relating to machinery (OJ L 207, 23.7.1998, p. 1, ELI: http://data.europa.eu/eli/dir/1998/37/oj). . (3) Moreover, by letter M/471 of 29 June 2010, the Commission made a further request to CEN (the second request), for the drafting, the revision and the completion of the work on harmonised standards in support of Directive 2006/42/EC to take account of amendments and additions introduced by Directive 2009/127/EC of the European Parliament and of the Council Directive 2009/127/EC of the European Parliament and of the Council of 21 October 2009 amending Directive 2006/42/EC with regard to machinery for pesticide application (OJ L 310, 25.11.2009, p. 29, ELI: http://data.europa.eu/eli/dir/2009/127/oj).

concerning the essential requirements on the protection of the environment with which, specifically, machinery for pesticide application must also comply with. (4) On the basis of the first request, CEN drafted the following new harmonised standards covering safety provisions: EN 415-2:2025 for packaging machines, EN 1459-4:2020+A1:2025 for rough-terrain trucks, EN 15180:2025 for food processing machinery, EN 17076:2020+A1:2025 for tower cranes, EN 17639:2025 for certain material handling cableway installations, and EN 17923:2025 for equipment for vine cultivation and wine making. (5) On the basis of the first request, CEN revised the following harmonised standards, the references of which are published in the Official Journal of the European Union by Commission Implementing Decision (EU) 2023/1586 Commission Implementing Decision (EU) 2023/1586 of 26 July 2023 on harmonised standards for machinery drafted in support of Directive 2006/42/EC of the European Parliament and of the Council (OJ L 194, 2.8.2023, p. 45, ELI: http://data.europa.eu/eli/dec_impl/2023/1586/oj). : EN 81-43:2009 for lifts, EN 415-8: 2008 for packaging machines, EN 1459-1:2017 for rough-terrain trucks, EN 13001-3-1:2012+A2:2018 for cranes, EN 13204:2016 for powered rescue tools for fire and rescue service use, EN 13852-1:2013 for offshore cranes, EN 14439:2006+A2:2009 for tower cranes, EN 15895:2011+A1:2018 for powder actuated hand-held fixing and hard marking tools, and EN 15954-2:2013 with EN 15955-2:2013 for certain equipment in railway applications. This resulted in the adoption of the following revising harmonised standards: EN 415-8:2025, EN 1459-1:2025, EN 13001-3-1:2025, EN 13204:2025, EN 13852-1:2025, EN 14439:2025, EN 15895:2025 and EN 15955-2:2025. (6) Furthermore, on the basis of the first request, CEN amended the following harmonised standards, the references of which are published in the Official Journal of the European Union by Implementing Decision (EU) 2023/1586: EN 1459-5:2020 for rough-terrain trucks, EN 12312-15:2006+A1:2009 for aircraft ground support equipment, EN 12965:2019 for tractors and machinery for agriculture and forestry, EN 12999:2020 for loader cranes, and EN 13155:2003+A2:2009 for crane lifting attachments. This resulted in the adoption of the consolidated harmonised standards EN 1459-5:2020+A1:2025, EN 12312-15:2020+A2:2025, EN 12965:2019+A1:2025, EN 12999:2020+A1:2025 and EN 13155:2020+A1:2025. (7) On the basis of the second request, CEN drafted harmonised standard EN 17744:2025 for agricultural and forestry machinery consisting of dusters with regard to minimising the potential risk of environmental contamination during use. (8) The Commission, together with CEN, has assessed whether those harmonised standards comply with the relevant request. (9) The following harmonised standards satisfy the safety objectives which they aim to cover and which are set out in Directive 2006/42/EC: EN 415-8:2025, EN 1459-1:2025, EN 1459-4:2020+A1:2025, EN 1459-5:2020+A1:2025, EN 12312-15:2020+A2:2025, EN 12965:2019+A1:2025, EN 12999:2020+A1:2025, EN 13001-3-1:2025, EN 13155:2020+A1:2025, EN 13204:2025, EN 13852-1:2025, EN 14439:2025, EN 15180:2025, EN 15895:2025, EN 15955-2:2025, EN 17076:2020+A1:2025, EN 17639:2025, EN 17744:2025 and EN 17923:2025. It is therefore appropriate to publish the references of those standards and amendments thereto in the Official Journal of the European Union.

(10) Annex I to Implementing Decision (EU) 2023/1586 lists the references of harmonised standards conferring a presumption of conformity with Directive 2006/42/EC. In order to ensure that the references of harmonised standards drafted in support of Directive 2006/42/EC are listed in one act, the references of harmonised standards EN 81-43:2025, EN 415-2:2025, EN 415-8:2025, EN 1459-1:2025, EN 1459-4:2020+A1:2025, EN 1459-5:2020+A1:2025, EN 12312-15:2020+A2:2025, EN 12965:2019+A1:2025, EN 12999:2020+A1:2025, EN 13001-3-1:2025, EN 13155:2020+A1:2025, EN 13204:2025, EN 13852-1:2025, EN 14439:2025, EN 15180:2025, EN 15895:2025, EN 15955-2:2025, EN 17076:2020+A1:2025, EN 17639:2025, EN 17744:2025 and EN 17923:2025 should be included in that Annex. (11) It is necessary to withdraw the references of harmonised standards EN 81-43:2009, EN 415-8:2008, EN 1459-1:2017, EN 1459-5:2020, EN 12312-15:2006+A1:2009, EN 12965:2019, EN 12999:2020, EN 13001-3-1:2012+A2:2018, EN 13155:2003+A2:2009, EN 13204:2016, EN 13852-1:2013, EN 14439:2006+A2:2009, EN 15895:2011+A1:2018, EN 15954-2:2013 and EN 15955-2:2013, given that they have been revised or amended, from the Official Journal of the European Union. It is therefore appropriate to delete those references from Annex I to Implementing Decision (EU) 2023/1586. (12) In order to give manufacturers sufficient time to adapt their machinery that is covered by harmonised standard EN 81-43:2009, EN 415-8:2008, EN 1459-1:2017, EN 1459-5:2020, EN 12312-15:2006+A1:2009, EN 12965:2019, EN 12999:2020, EN 13001-3-1:2012+A2:2018, EN 13155:2003+A2:2009, EN 13204:2016, EN 13852-1:2013, EN 14439:2006+A2:2009, EN 15895:2011+A1:2018, EN 15954-2:2013 or EN 15955-2:2013, it is necessary to defer the withdrawal of the references of those harmonised standards. (13) Given that harmonised standard EN 474-1:2022, with general safety provisions for earth-moving machinery, the reference of which is published in the Official Journal of the European Union by Implementing Decision (EU) 2023/1586, contains an editorial shortcoming to the detriment of manufacturers that may have implemented inherently safe maximum load limitation concepts, the Commission considers that this matter needs to be addressed. Namely, the values in its clauses 4.12.7.2 and 4.12.7.3 must be more accurately specified so that the appropriate values can be applied for the purposes of presumption of conformity. (14) Harmonised standard EN 1501-5:2021, for safety of lifting devices for refuse collection vehicles, the reference of which is published in the Official Journal of the European Union by Implementing Decision (EU) 2023/1586, has been further assessed by the Commission, together with the Expert Group on Machinery, on 7 November 2025. The Commission concluded that harmonised standard EN 1501-5:2021 fails to meet the essential health and safety requirements set out in points 1.1.7, 1.2.1 and 1.5.11 of Annex I to Directive 2006/42/EC. Namely, as regards point 1.1.7 of that Annex, harmonised standard EN 1501-5:2021 does not ensure that, when the machinery itself gives rise to a hazardous environment, adequate means are provided to ensure that the operator is protected against any foreseeable hazards, notably of becoming entangled in the lifting mechanism during foreseeable tasks such as clearing spilt material or manually loading oversized refuse, in particular when the machinery is in automatic mode. As regards point 1.2.1 of that Annex, harmonised standard EN 1501-5:2021 does not ensure the safety and reliability of control systems, notably reasonably foreseeable human error during operation does not lead to hazardous situations and the safety-related parts of the control system apply in a coherent way to the whole of an assembly of machinery. As regards point 1.5.11 of that Annex, harmonised standard EN 1501-5:2021 does not ensure that the design and construction of machinery is in such a way so that external radiation does not interfere with its operation.

(15) Harmonised standards EN 474-1:2022 and EN 1501-5:2021 should therefore be maintained in the Official Journal of the European Union with a restriction. (16) An error has been detected in the restriction of row 622a, Part Three, point 2, of Annex I to Implementing Decision (EU) 2023/1586, as regards the words such as tall trees, which is used as an example in that restriction. That error should be corrected with retroactive effect. (17) Implementing Decision (EU) 2023/1586 should therefore be amended and corrected accordingly. (18) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication, HAS ADOPTED THIS DECISION:

Article 1

Amendments to Implementing Decision (EU) 2023/1586 Implementing Decision (EU) 2023/1586 is amended as follows: (1) in Article 1, the second paragraph is replaced by the following: The references of the standards listed in Part Three, point 2, rows 24a, 121, 126a, 266, 324a, 343, 405, 495, 495a, 502a, 513a, 622a, 671a and 681a, of Annex I to this Decision are published or maintained in the Official Journal of the European Union with restrictions.; (2) Annex I is amended in accordance with the Annex to this Decision.

Article 2

Correction to Implementing Decision (EU) 2023/1586 In the restriction of row 622a, Part Three, point 2, of Annex I to Implementing Decision (EU) 2023/1586, the words such as tall trees shall be replaced by such as tall branches.

Article 3

Entry into force This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
