Council Decision (CFSP) 2026/762 of 30 March 2026 amending Decision 2010/413/CFSP concerning restrictive measures against Iran THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union, and in particular Article 29 thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy, Whereas: (1) On 26 July 2010, the Council adopted Decision 2010/413/CFSP Council Decision 2010/413/CFSP of 26 July 2010 concerning restrictive measures against Iran and repealing Common Position 2007/140/CFSP (OJ L 195, 27.7.2010, p. 39, ELI: http://data.europa.eu/eli/dec/2010/413/oj). . (2) On 29 September 2025, following the re-imposition of the United Nations (UN) nuclear-related sanctions on Iran in line with United Nations Security Council (UNSC) Resolution 2231 (2015), the Council adopted Decision (CFSP) 2025/1972 Council Decision (CFSP) 2025/1972 of 29 September 2025 amending Decision 2010/413/CFSP concerning restrictive measures against Iran (OJ L, 2025/1972, 29.9.2025, ELI: http://data.europa.eu/eli/dec/2025/1972/oj). which amended Decision 2010/413/CFSP and re-imposed all Union nuclear-related sanctions on Iran that had been suspended or terminated under the Joint Comprehensive Plan of Action. (3) In particular, the Council decided to re-impose the prohibition on the direct or indirect supply, sale or transfer dual-use goods and technology listed in Annex I to Council Regulation (EC) No 428/2009 Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items (OJ L 134, 29.5.2009, p. 1, ELI: http://data.europa.eu/eli/reg/2009/428/oj). for the use in, or benefit of, Iran. (4) On 20 May 2021, the Union adopted Regulation (EU) 2021/821 of the European Parliament and of the Council Regulation (EU) 2021/821 of the European Parliament and of the Council of 20 May 2021 setting up a Union regime for the control of exports, brokering, technical assistance, transit and transfer of dual-use items (OJ L 206, 11.6.2021, p. 1, ELI: http://data.europa.eu/eli/reg/2021/821/oj). . That Regulation repealed Regulation (EC) No 428/2009. (5) Decision 2010/413/CFSP should therefore be amended accordingly, HAS ADOPTED THIS DECISION:

Article 1

In Article 1(1) of Decision 2010/413/CFSP, point (e) is replaced by the following: (e) other dual-use goods and technology listed in Annex I to Regulation (EU) 2021/821 of the European Parliament and of the Council Regulation (EU) 2021/821 of the European Parliament and of the Council of 20 May 2021 setting up a Union regime for the control of exports, brokering, technical assistance, transit and transfer of dual-use items (OJ L 206, 11.6.2021, p. 1, ELI: http://data.europa.eu/eli/reg/2021/821/oj).. and not covered by point (a) of this paragraph except for certain items listed in Category 5, Parts 1 and 2, of Part VII of Annex I to that Regulation.

Article 2

This Decision shall enter into force on the day following the date of its publication in the Official Journal of the European Union.
