Commission Implementing Regulation (EU) 2026/826 of 14 April 2026 amending Implementing Regulation (EU) 2019/2072 as regards the listing of pests and rules on the introduction into, and movement within, the Union territory of plants, plant products and other objects THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC OJ L 317, 23.11.2016, p. 4, ELI: http://data.europa.eu/eli/reg/2016/2031/oj. , and in particular Article 5(2) and (3), Article 35(1), (2) and (5), Article 40(2), Article 41(2) and (3), Article 53(2), Article 54(2), Article 72(1), Article 74(1) and (2), Article 79(1) and Article 80(1) and (2) thereof, Whereas: (1) Commission Implementing Regulation (EU) 2019/2072 Commission Implementing Regulation (EU) 2019/2072 of 28 November 2019 establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 of the European Parliament and the Council, as regards protective measures against pests of plants, and repealing Commission Regulation (EC) No 690/2008 and amending Commission Implementing Regulation (EU) 2018/2019 (OJ L 319, 10.12.2019, p. 1, ELI: http://data.europa.eu/eli/reg_impl/2019/2072/oj). establishes a list of Union quarantine pests, protected zone quarantine pests and Union regulated non-quarantine pests (RNQPs). It further sets out requirements for the introduction into, or movement within, the Union territory of certain plants, plant products and other objects, in order to prevent the entry, establishment and spread of those pests in the Union territory. (2) Updated or new scientific and technical information from pest risk assessments, pest risk categorisations and pest risk analyses carried out by the European Food Safety Authority (the Authority), the European and Mediterranean Plant Protection Organisation (EPPO) and the Member States, is available and serves as a basis for listing new pests. As a result, the respective special requirements for the introduction into, and movement within, the Union of the plants, plant products and other objects affected by those pests, together with the respective rules on the certification of those commodities, need to be updated. (3) EPPO performed several risk analyses on the pests Agrilus bilineatus (Weber) EPPO (2019), Pest risk analysis for Agrilus bilineatus, available at https://gd.eppo.int/taxon/AGRLBL/documents. , Gymnandrosoma aurantianum Lima EPPO (2020), Pest Risk Analysis for Gymnandrosoma aurantianum (Lepidoptera: Tortricidae), citrus fruit borer, macadamia fruit borer, available at https://gd.eppo.int/taxon/ECDYAU/documents. and Naupactus xanthographus (Germar)

EPPO (2020), Pest risk analysis for Naupactus xanthographus, available at https://gd.eppo.int/taxon/NAUPXA/documents . . According to those analyses, those pests fulfil the conditions provided for in Article 3 and Section 1 of Annex I to Regulation (EU) 2016/2031 in respect of the Union territory. They should therefore be listed in Part A of Annex II to Implementing Regulation (EU) 2019/2072 as Union quarantine pests. (4) The pests Acidiella kagoshimensis (Miyake), Acidoxantha bombacis de Meijere, Callistomyia flavilabris Hering, Euphranta oshimensis (Shiraki), Gastrozona nigrifemur David & Hancock, Insizwa oblita (Munro), Paratephritis fukaii Shiraki, Paratephritis takeuchii Ito and Urophora christophi Loew, belonging to the family Tephritidae, no longer fulfil the conditions provided for in Article 3 and Section 1 of Annex I to Regulation (EU) 2016/2031 in respect of their potential unacceptable environmental, social and economic impact due to their host specificity. They should therefore be removed from the list in Part A of Annex II to Implementing Regulation (EU) 2019/2072 as Union quarantine pests. (5) On the basis of scientific and technical knowledge provided in the respective pest risk analysis carried out by EPPO, it is necessary to set out special requirements for the introduction into the Union territory of certain plants, plant products and other objects due to their likelihood of hosting the pests Agrilus bilineatus (Weber), Gymnandrosoma aurantianum Lima and Naupactus xanthographus (Germar). Therefore, the relevant plants and plant products, as well as the respective requirements, should be listed in Annexes VII and XI to Implementing Regulation (EU) 2019/2072. (6) The pest Ralstonia pseudosolanacearum Safni et al. is listed in Part A of Annex II to Implementing Regulation (EU) 2019/2072. However, that pest has been found in water samples in outbreaks reported in Hungary and in the Netherlands. Consequently, it should be listed as a pest known to occur in the Union territory and therefore it should be moved from Part A to Part B of Annex II to Implementing Regulation (EU) 2019/2072. Furthermore, the pest Ralstonia pseudosolanacearum Safni et al. has been found on imported plants of Curcuma longa L. and Zingiber officinale Roscoe. In the recent years, outbreaks of that pest have been reported in the Union territory, in nurseries where plants of Zingiber officinale Roscoe were grown. (7) Therefore, and in order to protect the Union territory from the phytosanitary risk of Ralstonia pseudosolanacearum Safni et al., special requirements should be set out for the introduction into the Union from third countries and for the movement within the Union territory of plants for planting and rhizomes of Curcuma longa L. and Zingiber officinale Roscoe. Consequently, Annexes XI and XIII to Implementing Regulation (EU) 2019/2072 should be amended to include plants of Curcuma longa L. and Zingiber officinale Roscoe. (8) The isle of Corsica (France), Ireland, with the exception of Galway city, and certain parts of Italy were recognised as protected zones with respect to Erwinia amylovora (Burr.) Winsl. et al. Ireland and France have requested, in accordance with Article 35(2) of Regulation (EU) 2016/2031, that the status of their entire territories as protected zones in respect of that protected zone quarantine pest is withdrawn. Italy has requested, in accordance with Article 35(2) of Regulation (EU) 2016/2031, the removal of the protected zone status of Liguria, Valle d’Aosta and some parts of the provinces of Lombardy and Tuscany. Following that request, the entire territory of France and Ireland, and some parts of Italy, should no longer be recognised as protected zones in respect to Erwinia amylovora (Burr.) Winsl. et al. The relevant entries in Annexes III, IX and X to Implementing Regulation (EU) 2019/2072 should thus be deleted.

(9) In Annex VII to Implementing Regulation (EU) 2019/2072, points 72.1, 72.2 and 72.3, the origin of the fruits of Capsicum L. and Solanum L., Annona L. and Carica papaya L., and Psidium guajava L. in relation to the pests Bactrocera latifrons (Hendel), Bactrocera dorsalis (Hendel), and Bactrocera dorsalis (Hendel) and Bactrocera zonata (Saunders) respectively, should be revised to include Israel and Taiwan, as they have been erroneously omitted. (10) In Annex VII to Implementing Regulation (EU) 2019/2072, points 32.2, 32.3, 32.4, 103, 104, 105, 106, 107 and 108, the origin of host plants and plant products of the pests Apriona germari (Hope), Apriona rugicollis Chevrolat and Apriona cinerea Chevrolat, should be revised to include Israel and Taiwan, as they have been erroneously omitted. (11) Outbreaks of Agrilus planipennis Fairmaire have recently taken place close to the border of Kazakhstan with Russia, which consequently require measures on certain species of plants and wood originating in Kazakhstan to prevent the entry of that pest into the Union territory. Therefore, the relevant provisions for the host plants of the specified pest in Annexes VII and XI to Implementing Regulation (EU) 2019/2072 should be amended accordingly in order to include also commodities originating from Kazakhstan. (12) Requirements exist in Annex VIII to Implementing Regulation (EU) 2019/2072 for the movement within the Union territory of plants for planting with roots, grown in the open air, that host Clavibacter sepedonicus (Spieckermann and Kotthoff) Nouioui et al. and Synchytrium endobioticum (Schilb.) Percival. Those requirements should be clarified by specifically mentioning relevant Union legislation for Synchytrium endobioticum (Schilb.) Percival, and in particular Commission Implementing Regulation (EU) 2022/1195 Commission Implementing Regulation (EU) 2022/1195 of 11 July 2022 establishing measures to eradicate and prevent the spread of Synchytrium endobioticum (Schilbersky) Percival (OJ L 185, 12.7.2022, p. 65, ELI: http://data.europa.eu/eli/reg_impl/2022/1195/oj). . (13) Accordingly, the internal movement requirements in Annex VIII to Implementing Regulation (EU) 2019/2072 for certain hosts of Globodera pallida (Stone) Behrens and Globodera rostochiensis (Wollenweber) Behrens should be amended to align them with the requirements set out in Commission Implementing Regulation (EU) 2022/1192 Commission Implementing Regulation (EU) 2022/1192 of 11 July 2022 establishing measures to eradicate and prevent the spread of Globodera pallida (Stone) Behrens and Globodera rostochiensis (Wollenweber) Behrens (OJ L 185, 12.7.2022, p. 12, ELI: http://data.europa.eu/eli/reg_impl/2022/1192/oj). . (14) Requirements exist in Annex VIII to Implementing Regulation (EU) 2019/2072 for the movement within the Union territory of plants for planting of Vitis L., other than seeds, that host Grapevine flavescence dorée phytoplasma. Those should be amended to include requirements for plants for planting, other than seeds, grown in a site of production with physical isolation against the introduction of Grapevine flavescence dorée phytoplasma and its vectors.

(15) Certain CN codes, or their descriptions, used in Annexes VII, X, XI, XII, XIII and XIV to Implementing Regulation (EU) 2019/2072, have been deleted from Annex I to Council Regulation (EEC) No 2658/87 Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (OJ L 256, 7.9.1987, p. 1, ELI: http://data.europa.eu/eli/reg/1987/2658/oj), as amended by Commission Implementing Regulation (EU) 2023/2364 of 26 September 2023 amending Annex I to Council Regulation (EEC) No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff (OJ L, 2023/2364, 31.10.2023, ELI: http://data.europa.eu/eli/reg_impl/2023/2364/oj). or replaced by other codes. Therefore, the references to those codes should be correspondingly amended in the Annexes to Implementing Regulation (EU) 2019/2072. (16) Certain CN codes, or their descriptions, have been erroneously omitted from Annexes VI, VII, XI and XII to Implementing Regulation (EU) 2019/2072, and thus should be added. (17) The phytosanitary risk of wood of Acer L., Aesculus L., Betula L., Fraxinus L., Populus L, Salix L and Ulmus L., in the form of sheets for veneering below 6 mm and sawdust in relation to the Union quarantine pest Anoplophora glabripennis (Motschulsky) is considered very low. For that reason, no special requirements apply for this type of wood. Therefore, those commodities should be removed from the relevant entry of Annex XI to Implementing Regulation (EU) 2019/2072. (18) Implementing Regulation (EU) 2019/2072 should therefore be amended accordingly. (19) The rules on listing new Union quarantine pests, the respective special requirements and the relevant amendment of the CN codes in Annex XI part A, as well as the revisions related to the pest Ralstonia pseudosolanacearum (Safni et al.) should apply from 15 October 2026. That period is necessary to allow the competent authorities and professional operators to adapt to the new requirements. (20) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, HAS ADOPTED THIS REGULATION:

Article 1

Implementing Regulation (EU) 2019/2072 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. Points (1)(a), (b) and (c), point (4), point 5(c), point (8)(a), (c), (f)(i), (f)(ii)(B), (g)(ii), g(iv)(B) and (11) of the Annex shall apply from 15 October 2026. and (ii) official inspections have been carried out in the place of production at appropriate times during the growing season, including a visual examination on representative samples of fruit, shown to be free from Gymnandrosoma aurantianum Lima; or (d) the fruits have been subjected to an effective systems approach to ensure freedom from Gymnandrosoma aurantianum Lima in accordance with the International Standards for Phytosanitary Measures ISPM 14 () and the use of a systems approach is indicated on the phytosanitary certificate, provided that the systems approach method has been communicated in advance in writing to the Commission by the national plant protection organisation of the country of origin.
